What Simon Lowe was suing about was that Harvey broke privilege by notifying Kessler that Lowe intended to merge with another company and leave Kessler in ruin, because he had already backed out on another deal. When Kessler backed out of the deal with Lowe (because Donna was dating Kessler and told him what was happening), and wrote an article in the paper basically calling Lowe unethical, Lowe contacted Hardman to sue Harvey and the firm. Hardman lied about him contacting Lowe.

To answer your question, an ex-employee could sue his old firm. However, keep in mind the situation presented here in the show is completely ridiculous and impossible to occur in real life. For conflict of interest purposes, every lawyer in a law firm is considered as the same entity. Meaning that one lawyer in a firm cannot break privilege by telling another lawyer something who is in the same firm. That’s the reason why two lawyers at the same firm cannot represent two different clients who are suing each other since anything they told their lawyer could be passed on to the other side without breaking privilege
