    It baffles me how artists don’t think about this in their contracts. The artwork is the collateral the record companies hold to lend you the money. I learned that while I was in H.S the play is to put in clauses of performance or the masters is 51/49% split between artist and company. If your project out performs projections then you get more % of ownership. So that project can be 90/10 or if it flops it swings the other way. But the record companies prey on the less educated artist.

    Well, yeah, but the thing is to understand that the record contract is a rate of return contract. You couldn't have those variable percentages depending on performance because the company at the top of the food chain needs certainty before advancing money. Remember that, by law, the masters still revert to the artist after 35 years.

    The thing is de-risk oneself as an artist by having some level of success before signing with a label. That's what gives leverage at the negotiating table. And then, in addition to performance clauses, one can insert a time period much earlier than the 35 years, for the masters to revert.

    Its like a bank loan, the banks charge you "interest/principal " toward a mortgage...after you pay that "interest/principal" you own your home...So yes the artist should get their masters back because the labels are definitely charging interest and principal...yes they put the money upfront but they are making that money plus "interest" from that artists....they are making double off the artists. Prince was right.

They would put themselves in harms way to stay the master.” Reminds me of Dave Chappell story about 3 card monty and he got duped for his money so he tried to warn another guy. To which he was almost beaten up but the man gave him a word of advice instead. He said “Never get in between a man and his meal.” Dave also said “taking away a man’s livelihood is akin to killing him.” So having the masters of the artist IS LITERALLY THESE PEOPLE’S LIVELIHOOD. Although it’s slimy and wrong and clearly taking advantage of someone, they still do it. Even if their was a split ownership of the masters where the artist owns the greater percentage after paying back the borrowed money that would be better at least a lot more fair.

    That's why I felt bad for Mase how Diddy did him. Yeah, he gave it back to him and all the rest of the artists he had, but I feel like Mase's not going to make as much money with his master's like how Diddy was making millions from them, there's gotta be another reason why he gave them back and I'm not talking about from the kindness his heart, but at least he gave them back. But if you look at DMX and see how much he made for Def Jam, they should have been gave him back his master's. I want to know if LL Cool J went through that too.
