दण्ड प्रक्रिया संहिता, 1973 की धारा 257 की परिभाषा:-
मजिस्ट्रेट को अगर लगता है कि परिवादी की शिकायत वापस लेने का निर्णय सही है तब मजिस्ट्रेट बिना आरोपी की स्वीकृति के परिवादी की शिकायत (परिवाद) को खारिज कर देगा एवं आरोपी या आरोपियों को दोषमुक्त कर देगा।
सीआरपीसी की धारा 257 क्या है?
यदि कोई शिकायतकर्ता इस अध्याय के तहत किसी भी मामले में अंतिम आदेश पारित करने से पहले किसी भी समय मजिस्ट्रेट को संतुष्ट करता है कि अभियुक्त के खिलाफ अपनी शिकायत वापस लेने की अनुमति देने के लिए पर्याप्त आधार हैं, या यदि एक से अधिक अभियुक्त हैं, तो सभी के खिलाफ या उनमें से कोई भी, मजिस्ट्रेट उसे अनुमति दे सकता है
सीआरपीसी के तहत निजी शिकायत क्या है?
क्रिमिनल कंप्लेंट 2 तरह की होती है। एक एफआईआर (प्रथम सूचना रिपोर्ट) और दूसरी निजी शिकायत एक शिकायत है जो मजिस्ट्रेट को मौखिक या लिखित रूप से दी जाती है , जबकि प्रथम सूचना रिपोर्ट अपराध के स्थान के पास के पुलिस स्टेशन में दर्ज की जाती है।
What is CRPC 257?
If a complainant, at any time before a final order is passed in any case under this Chapter, satisfies the Magistrate that there are sufficient grounds for permitting him to withdraw his complaint against the accused, or if there be more than one accused, against all or any of them, the Magistrate may permit him
Can a complainant withdraw a criminal case?
Yes. Criminal charges can indeed be dropped, this is what is typically called “withdrawn” in court.
Can a warrant case be withdrawn?
In a trial of a warrant case initiated on a private complaint, the complainant has no power to withdraw the complaint. The only provision which may have some relevance in this connection is Section 224 of the code
वारंट और समन में क्या अंतर है?
वारंट में ऐसे व्यक्ति को अदालत के समक्ष पेश करने के लिए किसी को व्यवस्थित करने के लिए एक स्वीकृत बल होता है, जबकि एक समन किसी व्यक्ति की उपस्थिति के लिए अदालत द्वारा जारी नोटिस मात्र होता है ।
सम्मन ट्रायल और वारंट ट्रायल में क्या अंतर है?
समन मामले की प्रक्रिया वारंट मामले में मुकदमे की प्रक्रिया के समान है, लेकिन मुकदमे के हर पहलू में एकमात्र मुख्य पहलू यह है कि अपराध की प्रकृति, यानी अपराध की गंभीरता सम्मन मामले में कम है जबकि वारंट मामले में अपराध संगीन होता है ।
