Criminal Record FAQ: Arrested but not Convicted?

Washington State Attorney Stefanie Dorn discusses arrest records in cases where there was no conviction, what an FBI file looks like in that situation, and the process to clear it up. Questions about your Washington State criminal record. Call now. (206) 222-8829 www.attorneydorn.com info@attorneydorn.com
Question: What does your criminal record look like if you have been arrested, meaning fingerprinted and either administratively or literally booked for an offense but not convicted, either it got dismissed or did not get charged. Answer: Your FBI record is still going to reflect the case information as well as the arrest data. The file in the video is from Google Images, because I’m not even showing my client’s redacted stuff.
But essentially, an arrest will still come back on the FBI file with the arresting data, the agency, and the change. Then it will have court data, maybe it will say dismissed on date. In order to remove that information from your FBI file, I work with clients in Washington State to expunge their arrest record, which removes the record from the Washington State Patrol non-conviction database as well as the FBI database, so that when an FBI report is run, it says your date of birth and name and says that there is no information for you.
So, that is the process to get your FBI record cleaned up if you have an arrest on your record. People do this for immigration, travel, employment, security clearances. My office helps people with this in Washington State only.

That is correct. Once your ass is in the fucking system they would rather die then erase anything. Expungement is a fucking scam.

That is true, fbi still sees arrests, no matter what you do, expunge, seal, etc

Hi Stefanie. I'm in this same boat but I live in California and my arrest was from here. I haven't been able to find any info for California law regarding this. I had my local public defender successfully seal my record (not expunge - I hear they may be two different things) but it still shows on the State and FBI personal review report when I run a fingerprint check on myself. The arrest record does show "Arrest Relief Granted Per 851.93 PC." I addesssed this concern with the public defender and was told that I only saw this because I ran a personal review on myself and I would always see everything but if other people run the same check, they won't see it. I'm not confident that the public defender is correct about this. Have you seen this situation and know if this is true? Please let me know. Thank you.

I’m sorry but the only thing I know about California law is I am not licensed to practice there. Www.Avvo.com is a good source. Search for expungement attorneys.

I tried buying a gun and got denied after getting like 20 approvals they told me I got convicted with a felony when I was 17 I’m now 29 and I got charged with a felony but it got dropped to a misdemeanor charge . Not sure why the atf and fbi are calling me a felon and not sure how I bought guns many times and got approved if that’s true
