Contradictory points solved for Paper 6D: 1. SARFAESI Act Section 31 - Provision not applicable where amt due less than ___ (20% or 25%) Opinion - Bare act and case study says 20%. Only ICAI module says 25%. But if you check ICAI Paper 4 Old course mat, it was 20%. It seems like an error in the 6D ICAI material Conclusion - Consider 20% for all purpose. 2. Section 3 of SARFAESI - Net owned fund of Rs. 2 crores or 100 crores: There is no contradiction here. Act says minimum NoF should be Rs. 2 crores or higher amount prescribed by RBI. RBI prescribed Rs. 100 crores 3. Competition Act - Notice to be sent to CCI in 30 days or 7 days? a. Whether it is 7 days or 30 days, there is a 5 years exemption from sending this notice w.e.f. 29th June 2017 (i.e., upto 29th June, 2022) b. Is it 7 days or 30 days - Here's the conclusion - It was 7 days until 2007. Then it was increased to 30 days till 2017. And then it was suspended for 5 years till 2022. So, the final answer would be 30 days. Again seems an error in ICAI 6D Mat. Apologies for having said 7 days in my revision video. Final answer - Notice to be given in 30 days

Sir there's one correction... Exemption of 5 years is for the time limit of 30 days and not for sending notice. Notice is to be sent compulsory (given on page 1.42 of module)

@@ritikbomb yes, that's the correct view. Notice would be valid even if sent after 30 days but penalty under 43A shall still be imposed and the time limit of 210 days shall be reckoned from the actual date of such notice.

1st point in there in corrigendum issued by ICAI, they corrected it to 20% 3rd point also they corrected by corrigendum, it is 30 days

Doubt 6D Eco law ............Competition act me 6(4) ka exemption to bank , pfi, FII etc jo h vo sirf Notice and effective date of combination wale provisions se exemption h right??? Combination provisions are still applicable to these if they cross threshold u/s 5 and are not exempted through de minimis exemption or other exemption given in sec 5 on pg 1.40?
