God bless Mr Nariman ! He is so clear and sharp even at the age of 94. Would Rajdeep be interested to get a reply that the 'Law minister is right' ? The reply he is expecting is perhaps not being affirmed or validated by Mr Nariman 😊😊

Fali sir is one of the top most jurist in the country and he has dropped the hint for a dialogue between the CJI and the law minister rather than going to the press for a solution. It's a good opinion coming from a distinguished Jurist and Sr Advocate. Let's wait and see how the respective parties react to this. Rajdeep, the interview with Fali sir is very timely and you grabbed the opportunity with both the hands. Keep the good work going.

Fali Nariman is a true judicious jurist and is an honest nationalist...speaking out the truth in an uncompromising manner...so vigorously at 94!😊 We heard about a russian woman living for 120 years, with all the vigor and a full memory! Why not the Mother Nature bless this land with such a gift and Nariman, the noble human to have thousands more sunrisers and keep the vigor alive to share with the generations to come!🙏 On the issue of debate, Nariman is seen struggling with all the modesty...dialogue between the cabinet colleague of the Leaders Narendra Damodar Modi and Amit Shah, probably that could be a characteristic of his Nature! We can surmise in a bold manner, as the People Of India holding the book of Constitution in hand that the judges and the political leaders are never co-equal and they cannot be placed on an equal pedestal. A judge elevated to a High Court from the bar at Forty, would travel ahead for TWENTY FIVE years without any hassles and witnessing FIVE Governments formed by the parties comprising of the elected members of a strength of 542, from 29 segments of the Democratic Republic of India! A decision taken by the legislature body in 2013 was certainly against the wishes and the desires of the legislature came into existence in 2014, continuing in two terms till 2024. It could be the same experience the country would be having in 2024 and in such a scenario, the proposals of co-sharing of the process of decision making in the appointment of the judges to the High Courts and the Supreme Court do not make any sense of wisdom and warrants a better solution for this country's judicial system. Its a big joke that there are crores of cases lying unsettled in the courts in India as on this date!! Why not we adopt the system of selecting efficient, intelligent, shrewd and honest human beings born anywhere in this country, not minding the regional, religious, caste balancing criteria, like how we induct the citizens of this country into the military, navy and airforces....only on merit and nothing but merit and merit alone!! It can be expressed in conclusion that the war of words between the cabinet colleague of the prime minister and the persons in the judiciary freely spoken out in the public media has certainly pulled down the credit and prestige of both the wings of the government to a cheap standard which was not seen in the last few decades! The change of the individual to sit in the office of the Law Minister is only a temporary measure not providing any solution as the issue is hanging for settlement by the leaders and not the junior colleagues! We wish that the human beings dealing with the issues be honest in finding a solution and resolving it in an honest manner, not giving scope to any attributions from any corner! Go back to the days prior to 1966 and be the true patriots and prove to be noble human beings!

Sardesai tried to fire his agenda narrative from the shoulders of FN, was not prepared and is ill equipped with facts. First shock to him that erstwhile NDA had constituted the venkatachelliah commission and its recommendation is available. Second startle to him judges job is not to appoint fellow judges. Third Stunner to him blocking of judges appointment during Emergency ( congress, see the look in his face, so evidently disappointed ). Fourth Astonishing fact " have a national commission". Fifth amazing point " the law minister was right of his PoV. Sixth Surprise " one is throwing stones at each other " ( boxer KO'd )

To CJI Sir, please read my comments carefully as nobody will tell you all this. Justice chandrachud has assumed office as CJI . As he is a highly qualified person will he bring about this urgent changes in judiciary ? : (Unfortunately he does not know what is happening in his backyard. PLEASE ALLOW Party-in-persons to argue their cases with out the mischief of registry : Asking silly questions, Raising silly defects, sleeping over it for years and finally ensuring dismissal of case by mischief in defects stage itself and that is happening in Supreme Court and the judges are looking the other side !! . In our country most lawyers are generalist. Also in High courts most cases are decided by common sense and there is nothing high law discussed to decide a case. Generally public can defend themselves and we don't need lawyers. Most lawyers after accepting a case don't care discuss with litigants and are casual. CJI is concerned about Survival of lawyers but not concerned about Survival of law and litigants. It is preached by lawyer community that any litigant should be represented by a lawyer and he cannot be allowed to represent himself directly as the lawyers not just protect litigants but also courts and our honourable courts want to believe that. However the reality is except for some exceptions most lawyers are neither faithful to courts nor to litigants but only to themselves and are after pocketing their fee. The competence of most lawyers in our High courts is just pathetic. Their sincerity and eagerness to win a case is also very low. So please allow party-in-persons to argue their case with out the hurdles put by the registry. In a recent PIL you have stated that we need good judges and also said that just increasing number of judges will not help but do you know that good judges can come from the system only if there is accountability of judges and today it is not all there. So please bring these urgent reform s. Unfortunately CJI only talks a statesman but has not brought out any changes so far.) 1. In high courts any appeal on decision of single judge must go to a bench of odd number of judges. If CJ is part of bench other judges on bench should be selected by another judge and not CJ. ( There should not be any even nuumber judges bench at all) 2. Any judgement that does not counter all the points raised in a petition should be automatically considered null and void 3.Any judgement must consider all the evidences presented and not a few selective ones .Otherwise the judgement should be considered null and void (Points 2 & 3 is already there in judges training manual of UP. A team citizens should monitor a case and ensure compliance. Just like jury but unlike jury system here the citizens should be given a check list .) 4. Any defect raised by registry maybe contested and should be resolved only by a judge this will prevent mischief by registry and now the registry is law unto itself raising silly defects 5.A party in person should be allowed to argue his case without giving any reason and without answering irrelevant questions like why he cannot engage a lawyer ? etc and without undergoing irrelevant procedures made to harass him and to finally drive him out or to force him to accept a lawyer 6. Most important the registrar or secretary general should not be allowed to make any rule without approval from a committee of judges appointed by CJI 7. Also cji should form a committee of judges to do a weekly review of the progress made by the registry. Today registry and secretary general are uncountable. cji should assert his authority over the secretary general. Please note judges don't come to court after studying the petitions listed for the day but casually walk in and see few lines here and there and expect party in person/ lawyer to make oral presentation. They are so lazy. If a case has to be decided only oral submissions why detailed written notarized submissions are made after painfully curing all the defects by the mischievous registry. So it is no wonder Indian judges dispose of hundreds of cases in a week as the judgements are unfair and casual to say the least. Please note litigants wait for years but judges dispose of the case with in minutes and some times even in a few seconds !! ( no it is not exaggeration ). Only choice left for the litigant is to go on appeal but there are also situation is the same (CJ and his favourite judge will decide the case So it effectively is CJ's judgment and the other judge is dummy) Lawyers are least concerned about the flaws in the system but are only after collecting their fee. Please note it is not just speedy justice that is required but also high quality, fair judgment that is more important. However today it is totally lacking in judgements of High courts. Litigants wait for years but judges dispose of cases with out even reading the petition. Only option left for litigants is to go on appeal but even there situation is same or worse. Please abolish the SL senior lawyer designation in HCs and SC. These SLs misuse their direct and private access to judges to kill a case if it is not as per their view.
