    They all have a pension fund vested or not. A jury has the power to attach those pension funds, present or future to a settlement. Then and only then utilize the municipality’s bond to satisfy the settlement.

    I live in Elkhart County, IN...I recently heard that the city of Elkhart is on the hook for about $8m for the stupid stuff their officers have done....all out of the taxpayers pockets....

    @@tomcampbell6384 The “taxpayers” pay the premiums on the community’s bond. That insures the community against these sort of lawsuits. The fewer lawsuits against the community. The lower the premiums. Allowing a margin of a learning curve before the community is bankrupted from litigation. The responsibility in keeping that bond premium cost down is incumbent upon the community leaders to provide proper training, protocols and discipline of it’s public servants. Any settlement over wrongful behavior, unlawful actions or endangering the public is a failure of the community’s leadership to manage it’s employees.

    He should also be responsible for the legal fees of the defendant which are substantial. Lets not forget the administration of the police department who makes this all possible by allowing the charges, furthering the charges and retaining the bad officers who commit these crimes.

    @@frotobaggins7169 take it a step further, its the tax payers who enable this by not demanding civilian review boards, controls on liability and changes to policy. This is why I do not feel bad that they have to pay more taxes to cover the abuses of their employees, hurting their pocketbook is the only way to get them interested in doing the right thing.

    I'm dealing with that now myself......6 false warrants on myself and my wife.... We've spent everything we had saved and by the grace of God our house is paid for or we would be homeless..... they wanted to take us away from our kids by arresting us together, but we did not let them get that satisfaction..... Now they can't give me any info because they say there's "nothing in the system"...... doesn't change what I'm GOING to be compensated for..... they WILL BE HELD ACCOUNTABLE, BOTH CRIMINALLY, CIVILLY, AND IF NEED BE...... eternally

    Any unlawful arrest should cost a city a minimum of %5 million and the department should lose five years budget. They should be required to sell assets to make payroll.

    So what you’re saying is if the police department makes a mistake the citizens of that jurisdiction don’t get police protection for five years. Good luck getting that law passed. Sell assets? Think about that they sell the assets for less than what it cost to buy them. Then the citizens have to buy new. Congratulations you found a way to make the taxpayers pay even more money for the mistake.

    I would suggest that both civil and criminal personal accountability for officers that violate the law is a better solution. When the settlement is provided by the government, it's actually the taxpayer that pays for it, and provides no personal disincentive for individual officers to violate rights. Ending qualified immunity and requiring that police officers provide indemnity insurance at their own expense would make rogue officers uninsurable, and therefore unemployable. It would also protect taxpayers from having to pay for their misdeeds.

    Anytime a lawsuit is won..if it's over $25,000 the city employee should be fired or have to pay it themselves. One way to get rid of those who cost the citizens

    I was falsely arrested too, in florida, spent 36 hours in lockup, bailed out and fought for 3 years to the point of going to trial where upon the state attorney of florida dropped their charges, they tried to get me to plea to a lower charge so I could not sue, I called their bluff and asked for a jury trial, they Immediately dropped the charge "nolle prosequi" meaning to evidence to prosecute, I am now suing here in florida.

    As a former federal case juror. It is necessary to attach a good portion of the officer’s retirement to these settlements. When offending officers are made financially responsible for their actions. Their behavior will change..

    You were on a jury big deal. Lots of people have. Don’t know why you decided to mention it. So what you’re saying is you also want to risk your retirement where if you screw up you lose your retirement money I don’t care if it’s a 401(k), or Social Security fair is fair, you screw up at work you spend your retirement years as a Walmart greeter or whatever you have to do to get by. The penalty for doing a bad job is getting fired. The officer is not even fired, but your plan is to make no one want the job. And anyone dumb enough to take it would have to retire immediately 20 years to avoid the risk put some thought into it federal Juror.

    @@neilkurzman4907 I was on a jury that assigned a financial responsibility to 2 Sheriffs who financially and openly used their position to punitively punish Deputies and jail staff for their service to the public. In a just and equitable manner without burdening the taxpayers of the community. Yeah, it was a big deal. Firstly, a clear and direct message to those who feel they are above the law. Secondly, displayed to the citizens. Served by two elected, career public servants, That they truly can be held personally and financially responsible for their actions. Thirdly, exposed their actions by a jury of their peers to the electorate of corruption within the ranks of a Sheriff’s department. Lastly, handed down a fair and just settlement that only impacted the county’s bonding insurance and those responsible to be divided between 6 plaintiffs. 750k from bond and a reasonable pension garnishment from two career sheriffs. Not so excessive to motivate an appeal. But enough for a just compensation and recognition of a balanced judicial system. Certainly a “big deal” to the plaintiffs, the defendants and the local citizenship..

    Should have been 1.5 million every 24 hrs locked up. Attorneys are for the best deal for the courts. Anyone that's ever been arrested should look at the case law on this.

    There isn't any incentive for the police to not just grab someone that doesn't fit the description and charge them with a felony. The cop has faced zero consequences for charging the wrong person. The DA will not face any consequences for filing those charges. Until we hold police and DA's accountable no one is safe from false charges. Until it happens to you or your loved ones you don't know how easy it actually is.

    Any officers involved should be arrested at gunpoint, subject to the same intensive search and spend 7 days in jail for their gross incompetence. The process is the punishment. This should not just apply to civilians.

    Due to rule 68. If you reject the settlement offer and then are awarded less than the offer then you have to pay their legal costs, which will be enormous. You can win a case and end up owing more than you get due to rule 68. That's why a clients attorney often advises them to accept the offer.

    That's what I need to pursue. Wrongfully arrested on a stray dog call ! Came home after short trip to supermarket. Police entered the house on a " welfare call " thru a back door. When I challenged them I was arrested. False arrest report...

    It's interesting that the amount awarded is easily divided by 3. Lawyers usually get one third of any settlement. They made it easy for the lawyer to figure out his fee. Just an observation.

    These cops are acting at a level they are capable of and according to the training and environment they work in. This is who they are and what they do. You can't change them, you have to replace them with people better qualified, smarter, and who are trained much differently. Once the dough is messed up you can't cook good biscuits. You throw it out and do it right.

    Qualified Immunity is OK provided it is QUALIFIED. That is the breakdown. The police who are QUALIFIED should have met ALL the conditions of Qualification. If all the rules were followed, and all the I's dotted and T's crossed, then they should be qualified. They need that because Criminals will take any opening they can get. In this case they were DISQUALIFIED by their incompetence.

    That's what we see too often. Poor public skills, lazy police work. Jumping in with both feet without gathering the facts. The piss poor way they treat the public. Police need Publix support and trust to be effective. How many cops do you see speeding down streets while on routine patrol with a cell phone stuck to their head and windows up. In 20 yrs the drivers window in my car stayed down. We need to hear things like a dog barking, glass breaking, a woman screaming, even a gun shot. I was in the Wash DC area where we had snow/sleet, thunderstorms. My window was down. Your head has to be on the job. Speak to people the you would want your wife or mother spoken to. In the 80's we called it Community Policing.

    The arresting officer got a paid vacation with time off and got back to work after that. OH well the city has to pay for my screwups. Instead of losing his law enforcement certification that is what is needed.

    Many employers treat and view an arrest as the same as a conviction. When a background check comes up with aggravated robbery arrest- that employer will trash the application even though it’s a false arrest wherein the charges were dropped. That 375k settlement will help.

    Police don't care the money doesn't come out of their pockets. Once again the tax payers end up footing the bill.
