Brief description of the video
In this video, legal expert Adv Kunal Seth will discuss a landmark judgement of the Hon’ble Supreme Court passed on 28, October, 2021 in Sripati Singh (since deceased) Through His Son Gaurav Singh Vs State of Jharkhand & Anr.
The Honourable Supreme Court observed that Section 138 of the Negotiable Instruments Act is attracted where a cheque given as security is dishonoured provided that the cheque was presented for payment when the debt became due.

sir as my company aske me to deposit a cheque as a security purpose now he has deposited in bank and the cheque is bounced now in this situation what should i do . he did it because i left the job.

If the company can show a legally enforceable debt, a cheque dishonour case is made out. What was the liability against which the cheque was given?
Sir agar cheque company ke naam ho to kya koi personal naam se case kar sakta hai ya wo case dismiss ho jayega

Company and its directors have to be made party to case. If company is not made party, case against directors will be dismissed.
Sir maine 3saal pehle gaadi li thi emi par uski 10 11 kisht di or mera karobar thapp ho gaya maine khud unko gaadi dedi ke mere se emi nahi de hogi maine unko gadi bhi dedi or ab unhone mera cheque laga diya parso ab mai kya karu sir mere paas koi kam bhi nahi chal raha mushkil se ghar ka guzara chala raha hu meri ek laat ko polio hai kuch or kar bhi nahi sakta mere do chote bache hai please koi hal bbatayeya

सर मेरी माताजी ने मेरी पढ़ाई के लिए सरकारी बैंक से लोन लिया था, और एक खाली चैक सिक्यूरिटी के रुप में दिया था, अब वो लोग अधिक राशि वसूलने के लिए ऊस चेक में अधिक रकम भरकर बाउंस करवा चुके और कोर्ट में केस भी रजिस्टर हो चुका है अब हम कैसे बचेंगे सर हमारे साथ गलत हुआ है।

सर मैंने जमीन बेचने का एग्रीमेंट किया जिसमें बयाना के रूप में 5 लाख रुपये के दो चेक क्रेता ने दिया। दोनो चेक बाउंस हो गये क्या चेक बाउंस का केस बनता है

To the best of my understanding, fees of auctioneer is fixed by court, you can ask the court Nazir about the complete auction process.
We also have a security cheque given by the borrower but we don't have a written agreement we have given payment through bank transfer, can we use the party under 138 NI act.please guide us, thanks

If there is no agreement, the cheque cannot be treated as a security cheque rather, it can be said that the cheque was given to repay the loan. You can deposit the cheque in the bank, if it gets dishonored, file case u/s 138 NI Act. You may contact me to discuss 9560907999

If a repayment date has been agreed upon, cheque can be deposited on payment becoming due. If no repayment date is agreed upon , send a legal notice for repayment of loan, failing which the cheques shall be deposited.

सर मेरे ऊपर एक चेक बाउंस का कैसे हो गया है लेकिन लेकिन मुकदमा करने वाले से मेरा चेक गुम हो गया चेकपर मुकदमा करने वाले ने कटिंग करके चेक लगायाथा ऐसी स्थिति में हैंडराइटिंग विशेषज्ञ आदेश हुआ जिस दिन विशेषज्ञ आया उसी दिन 65 बाई का आवेदन आ गया और जजसब ने 65 बाई का आवेदन स्वीकारकर लिया मैंने उसे 65 वीक के आवेदन को स्वीकार करने हाई कोर्ट में चलेकर दिया सर ऐसी स्थिति मेंक्या होगा

If the bounced cheque is lost, no case of cheque bounce can be made out. If there is cutting/overwriting on cheque which is affirmed by handwriting expert, then cheque bounce case must be dismissed.

@@AdvKunalSeth सर दो साल पहले मै 2.50 लाख रू.आर टि.जि.एस. किए बिल्डर को वह अँग्री मेंट दिए अब किसान और उसमे विवाद हुआ उसने मुझे आँफिस बुलाया अँग्री मेंट क्रास मारा वह मेरे पास है और अनडेटेड चेक दिए दो जिसमे रू.और साईन है मै कहु तब लगाए बोला अब दो महिने हो गए

Sir very nice Your suggestion, i really appreciate, Sir i am respondent 138 case for my 5 lakh amount , submitted in local court and i win,2nd in district court i win the appellant went to Gujarat high cort for obsaction against court judgment, last 6 years 2018 have in gjhc, they didn't gave me Date total my 12 years finished my advocate also only waiting for date but please can u give me some advice, can fax to gjhc, for my case?
