CBS News finds medical boards often fail to discipline doctors for malpractice

A year-long CBS News investigation has found that the system of state medical boards responsible for disciplining doctors who repeatedly injure their patients often fails to discipline those doctors, leaving the public in the dark. Jim Axelrod traveled to Indiana to examine this system of state medical boards that many in the field say protects doctors instead of patients.

    Especially in Idaho where there is not a malpractice law in place to protect patients. A man I know can no longer walk because of a doctor and he has been refused help by Idaho and Idaho medical board 😕 I don't trust doctors or medical industry unfortunately

    My husband is one of those people who is now paralyzed from the waist down from an Indiana doctor (anesthesiologist). He has burning nerve damage below his waist. Can’t walk. Massive bowel problems. It’s been 15 years. He was a tennis coach and tv/radio teacher at a high school here in Floyd County, In. He went for a hernia surgery and came out burning with pain and couldn’t walk. The “doctor” Art Duncan messed up the epidural but did nothing about it. They sent him home after the surgery. It goes on and on. We had a trial but didn’t get a red cent. He had been sued before too. Had a great lawyer. 15 years my husband has been like this. It was done at Floyd Memorial Hospital in New Albany in October of 2005, across from Louisville Ky. The hospital is now Baptist Hospital Floyd. It’s been a nightmare for our whole family.     I was walking before with a limp before I had back surgery in 2020. The surgeon Dr Rahim Javahery from Long Beach, California, told me that if I have the surgery to clean scar tissue from a previous surgery, it would help me walk better. Had the surgery got worse, had to go back for a revision surgery, now even worse and is crippled by this uncivilized mutt. Can I get my due diligence he has been sued previously two times and was accused of being responsible for causing the death of another patient, but yet there has been no discipline to this doctor. A lawsuit was filed on my behalf on a lawyer who was not competent taking this type of case, saying that he could not prove that care was below standard. I was walking unassisted with a waddle gait prior to this. Now this man has crippled me. I will never give up this fight to hold him responsible for what I was told from another surgeon that the surgery was unnecessary. This is a crime

    The medical profession is like the Catholic Church protecting their own. This will not change until the liability ins companies get tired of paying huge law suits. If you find yourself on a jury in a law suit give the victim as much money as you can, it's the only say patients have in the matter.

    I think another side of this story needs to be told . If a Dr makes medical error they should be hold responsible, punished, reprimanded. BUT what is happening is the Drs who are being punished are the ones who are speaking out and telling the dangerous Drs or safety concerns. The Medical bd will attack them . Silence them . This is a pattern of what is going on , and most Drs are not aware. This happens with nurses too . Try reporting a dangerous Dr , or safety concern, and you will be fired , blackballed , reported to your corrupt board of nursing and never work again, in many fields. (when laws protect those who speak up only then will it change . When boards stop protecting hospitals , because those on boards are appointed by corrupt politicians, and some are on staff at those hospitals. Only then will it change. Gail King should know this, Oprah just offered a vacation to a DR who spoke up at corrupt hospital YUMA MEDICAL CENTER, YUMA AZ who fired an ER doc in the middle of a pandemic. For speaking out about covid. But Drs who cause harm are impaired still there .

    I'm a victim of malpractice, and currently am still trying to address the problem. They are protected by a steel curtain! I'm a plumber for over 15 yrs and had to apply for disability. I have to live with my mother and survive on a fraction of what I was making per month. I'm a citizen of Pennsylvania, and I lost complete function of my left hand. The surgeries were done without my consent, Pennsylvania law calls that battery! But I will not give up!

    My wife went to the hospital in big spring texas with a broken neck and a broken back. They sent her home... She died and was revived three days later in San Angelo...

    Just as with law enforcement, doctors should have independent/ civilians groups , review boards, checking up on them, you can't expect them to govern themselves or corruption will abound.

    Insurance companies have to work for the patients who pay the premiums. If they don't it shows they are hand in glove with the medical community and especially the doctors who are frauds.

    Horrible doctors I have encountered who mistreated so many are somehow still in practice. I'm honestly not surprised by anything anymore. Malpractice suits are not easy for patients to win. We hear about this absolutely vile cases like the ones in this story... but what about all the DAMAGING bad advice doctors are giving their patients that have a cause/effect relationship with the patient eventually dying? (I.e. refusing to address a problem that could be life threatening... constantly dismissing patients. Patients who LATER find out they had something major like cancer or an autoimmune disease or an infection that turned septic. I almost died from sepsis because my doctor refused to address my UTI. But could I prove malpractice? no. SAD.

    I can identify. We lost a close family member to a treatable condition. Physician noted in chart that patient had "somatic delusion." Refused to refer, even though a previous specialist reported a need to follow up. No biggie to the medical board. Doctors are allowed to make mistakes (pass the buck).

    @@mylittlekittens I'm so sorry for your loss. I would go public with the story however you can even if you have to anonymize some details at least raise awareness or put that particular practitioner on blast. They might win a lawsuit with all of the protection they have but if word gets out hopefully some people will think twice about getting treatment from them.

    @@anonymousandcool You can't really go public with claims alone. New York gives little monetary value to a single person ( with no heirs), so lawyers not interested in this case. Strange thing is, after the investigation, a letter was sent from the medical board on how to get a "FOIL" request. After the request, their reply was that this info was confidential due to the nature of the investigation. Why tell someone how to request information they are not supposed to have? It's whacked!

    Today I was told something so repulsive I nearly threw up. My bf husband had cancer a few yrs back. For the last few yrs he has gone for regular checkups and given the all clear. Few months ago he noticed a lump on his ankle so they went in for him to be checked. They repeatedly kept performing the same test and giving him an all clear. This last visit my bf asked why they had not been running test on his ankle all these months since that's where the knot is. The medical professional told her, your husband has to ask for the specific test we don't offer it and she as his wife cld not ask he has to ask. The name of the test I cannot rmb NVR heard of it but had this nurse not told them this they wld have continued the same test without ever giving him the test he needed bc he did not ask for it. This is appalling and the medical professional is now monopolized into groups. They are leaving patients sick and sending them for test after test so each person in that group can get their slice of the pie. The medical industry is all this country has left everything else has been sourced out. Don't be surprised when sickness and viruses run rampant. The future for us looks so very bleak.

    3 years ago I was disabled by medical malpractice at 31 years old. A urologist gave me Ciprofloxacin, a last resort antibiotic reserved for life threatening infections, as a prophylactic without having any idea what was wrong with me. I was crippled 3 days later and still haven’t recovered. I required 5 ankle surgeries for various tendon ruptures. Despite the FDA revising its recommendations that these drugs be used as a last resort, it is objectively and empirically malpractice to give it as a precaution if an injury then occurs. The Florida medical board cleared him of wrongdoing and killed my chances of a lawsuit. It’s a country club. A good old boys club. This is a fraternity and you can’t expect them to prosecute the people they play golf with on weekends. Instead they help the colleague bury the body. Your body. Oaths to do no harm be damned

    @@Wallychans Everyone always acts super surprised when patients attack their doctors, sometimes extremely violently. Remember that guy in 2022 who had botched back surgery, and his doctor/mutilator ignored his calls for pain management and he went crazy? I don't necessarily condone what he did, but what did you think was going to happen when you back any wounded animal into a corner? I personally am not going to take vigilante revenge, because I AM in the process of recovering, I've gained about 50% function back, and THAT is the doctor's worst nightmare. That I am strong enough to hand out leaflets outside his office telling people what he did. That I am strong enough to put his name on a website. That i am strong enough to defend myself in court when the inevitable frivolous "defamation" lawsuit occurs to shut you up. Hurting their reputation and pocket book can be just as satisfying.

    My husband died as a result of malpractice in a hospital in Baton Rouge La. His breathing tube was dislodged while turning, his arm was full of blisters and skin loss, from IV infiltration, Doctor wrote wrong information in medical records, test ran on wrong patient according to medical records, dialysis was delayed until it was too late. etc. According to the medical review panel which was made up by three doctors, one who was affiliated with the hospital we suing, another last minute one who didn't pay much attention to the facts we presented and another one we chose because he was recommended did not even participate in the meeting. But, the panel ruled in favor of the defendants even though one nurse license was suspended. They did nothing wrong, the panel said. Now we have 90 days to find a lawyer, and so far, everyone is turning us down. The medical review panel is a joke.

    True, i was misdiagnosed with endometriosis and I was pushed to get a hysterectomy. The radiologist doing the ultrasounds on pregnant patients is still working for the same practice in Dallas TX. 😢 it is devastating to know that more women are still being harmed. 😭

    A doctor out here, on the West coast, caused me to have chronic nerve pain with bowel issues after a gynecological surgery No lawyer would take my case. The doctor’s name was Ralph Mayer. He’s a Uro-gynecologist All I could do was leave a bad Google review and hope to spare any female , if pain, that will take my warning serious.

    A psychiatrist here in Tennessee prescribed OPIOIDS for a mentally ill patient and started a sexual relationship with her! When she stopped it, he went to her home and banged on the door. She didn't answer. He went to her neighbor's house, said his patient was in danger and the neighbor let him into the woman's house with a spare key. He let himself in and crawled all over her. Luckily, she got him to leave. He got a little slap on the wrist and is still practicing in our city. I confronted the state board and they just blew me off.

    In our case the the neurosurgeon did a tumor resection that injured my daughter severely. When we mentioned it to the tumor doctor he reported us to CPS and reported false allegations we are 6 months fighting the system because of his false allegations. Its hard to go after a doctor. Fortunately the CPS report does show he had control of records released, he cancelled our second opinion and didn't let us move our daughter to another facility.

    It’s hilarious to me that nurses who have only a 4 year degree, get to decide between life and death. I would say, it shouldn’t be argued with because of the high demand rn, but honestly people have been killed due to this medical negligence that stems from lack of knowledge, and hospitals are only short on nurses because when nurses found out they get paid three times as much to become travel nurses, they all left the hospitals, so really I no longer think nurses are all heroes. Also, they really be having just anyone hand out the drugs to patients each day. I’ve heard so many patients have had overdosed in the hospital because the staff forced them drugs. Also misdiagnosis is very real. Also I was suffering from sinus bradycardia when I was 10 years old, and I was severely underweight to the point where I couldn’t move up from my bed and this lasted 3 years I had a heart rate that sometimes went down to 14 bpm. When this happened my heart monitor would go off and alert the nurses but when they came in and saw I was dying they literally were freaking out running around and telling me I was going to die. Which is not what you want to hear as a 10 year old even if it is the cold hard truth. The nurses could have, at least, not been panicking because they stabbed me so hard with the IV in their panic. They were freaking me out about death, rather than reassuring me that I would be alright if I died. My parents weren’t there so I would have died alone and all I wanted was to have a nurse reassure me but instead they were chaotic and rude.

Look, Einstein, if you believe every crime that happens is reported by a news media outlet, you are crazy. You're lucky if you know about 10% of the crimes that happen every day. As this video shows, hiding the crimes allowed them to continue, the same was true for Dr. Nasser. Sadly, it's all about money, hospital privileges, and lawsuits. A single doctor is insignificant to the hospital, but he knows the hospital will cover for him to keep from being sued; it's a sick reality, but a reality nun the less. The Institute of Medicine report estimated 98,000 Americans were dying annually due to medical errors. Estimates of annual patient deaths due to medical errors have since risen steadily to 440,000 lives, making medical errors the country's third-leading cause of death. Mar 17, 2020. Covid deaths are at 304,000 Sloppy Doctors (440,000) > Covid (304,000) And that's every year.
