They do, those with average or better intelligence get out of it. People on juries are either morons or government employees that are both bored and lonely or both. People with jobs not related to any form of public govt services can’t afford to serve on a jury long term. If you want some idea of what kind of rocket scientists can’t manage to get past the first phase, just search the potential juror in this case that was held in contempt. He has trouble tying his shoes, I promise. But even HE found an out for $450.

I don't even know if having 12 random people off the street make decisions like this is a good idea. It might be better to have experts in law, crime, forensic science, and related fields. Professional juries, if you will. Both sides spent millions of dollars to have experts testify and most likely the jury didn't understand 10% of it. I'm not even saying the jury was wrong here. I think it's debatable. Casey obviously did something bad and wrong but the State couldn't really paint a solid picture of what happened .

@@darkwillow57 I think the jury was ABSOLUTELY wrong here. Like “How could ANYONE have gotten it SO wrong?”! I think you’re onto something with the professional juries idea, though. This jury clearly didn’t understand reasonable doubt, and circumstantial evidence, and as such, came out with an absolutely RIDICULOUS verdict. It’s an outrage TO THIS DAY!

@@darkwillow57 if you think the state couldn't give a solid picture of what happened then you are one of the people that shouldn't ever be a juror. The case was very easy to follow. There was no point in the entire investigation that casey anthony told the truth and she never expressed concern for her child's well-being - strike one. The day of the murder she searched up fool proof suffocation, she started partying non stop while her kid was missing, she never contacted police until she was forced to by her mother after 31 days of killing her daughter - strike two. The body was found 1 mile away from her house, there were diary entries of her feeling better dated right after the murder, and she was the last person to be seen with her daughter - strike three. There's something in the water in Florida for her to get away with what what she got away with. I guess all you need to get away with murder in Florida is to be a white female and dump the body in a swamp because no amount of evidence is going to incriminate you.

@@darkwillow57 one of the ways they teach it to you in law school is with this scenario: you were going to bed and before you went to bed you noticed rain clouds in the sky, next morning you wake up and see that everything outside is wet. The reasonable assumption would be that it rained. It’s “possible” that somebody took a hose and sprayed everything in your neighborhood with water and it didn’t rain which would count as a doubt but it’s not reasonable to believe that happened. The reasonable belief would be that it rained and there are no reasonable doubts that disprove that it rained because every other scenario is asinine and the evidence, eg rain clouds and weather, points to rain.

Jurors have no right to correct the questions from the court and have no right to add any comment in the answer. Main question was only about first degree murder. Why did the prosecution decide to put the charge for second degree out of the table ? Why the only possible answers were guilty or not guilty instead of yes/no ? For me the justice system failed to ask the right questions and also failed to provide the good tools to each jurors.

The reports are that there was very little note taking and there wasn't a single request to go over evidence. Instead of 12 angry men (movie) we got 12 easy going jurors. Of the two who voted guilty the first time, where was their passion to at least make their case? It seems like the two who voted guilty just went along right away.

  • @CeeBee781
    @CeeBee7812 жыл бұрын

This is why jurors need to be thoroughly and properly instructed. The first reason given for the not guilty verdict is that the prosecution couldn’t show them precisely how Caylee died. That is not necessary to prove. The death was ruled a homicide. It is not necessary for the prosecution to prove exactly how the homicide occurred. They only needed to prove beyond a reasonable doubt that Casey committed the murder. And they did that. No reasonable person would conclude, after hearing all the evidence, that Casey Anthony did not kill her daughter. The precise method and circumstance is not important. There’s no way to ever prove that. If the prosecution always had to prove precisely how a murder occurred, no one would ever go away for murder. A juror needs to look at the preponderance of evidence. There is never a 100% guarantee that a guilty verdict is correct. But when you find yourself thinking of all the crazy coincidences, the insane explanations and unbelievable hypotheticals that would have to be true for a person to be innocent, you should be seriously considering a guilty verdict. That is the point of circumstantial evidence. If there is enough of it, any reasonable person would conclude the person is guilty even while lacking something like a literal video of the murder. In order for Casey to be innocent, what would have to be true? Firstly, she had some kind of traumatic past or brain disorder that causes her to constantly lie, even about things she’s innocent of. So, she’s not lying to cover up something horrible she did, she’s lying cause she just can’t help it. Secondly, she is in some kind of deep denial brought on by the trauma of losing her daughter which is causing her to act absolutely thrilled. So, she’s not partying and writing about how happy she is because she’s actually glad Caylee is gone, she’s doing it because she’s so deeply unhappy and traumatized deep down and this is how she copes. Thirdly, the computer searches about “foolproof suffocation” and chloroform, made while no one else was home and between Casey logging into her own social media and email accounts, were totally innocent and coincidental. Fifth, her not calling the cops, ever, was not to protect herself or avoid responsibility for anything, but was actually part of her strange way of coping with her daughter’s death. I could go on and on. One of these things might be an unlucky coincidence, but put them all together, and you would have to be an absolute imbecile to find Casey not guilty. And maybe the jurors are all imbeciles. Who knows. Here’s something I’m sure of: If Casey Anthony were unattractive, black, and/or male, she’d be imprison right now. This jury didn’t know what they were doing. They did not deliberate long enough. They were not properly instructed. And they failed that little girl. They failed her terribly and a child killer walks free among us.

the public gets its misconception about circumstantial evidence. the fact that a case is circumstantial does not mean that it is weak. tt simply means that jurors must weigh the evidence and take the second step of reaching an independent conclusion. circumstantial evidence is nothing more than what we live by on a daily basis as a matter of common sense

If you needed DNA on bones, an eyewitness and an exact explanatiion from a prosecutor to get a murder conviction, there would be about 10 people on death row in this country. After listening to him speak, now I understand why Casey is walking free. This was the forman people, that says a lot of the rest of the jurors involved in this. Caylee never stood a chance to get the justice she so much deserved, She was murdered by the one person who was supposed to have protected and loved her the most, and now in death her hope for justice was denied because this man was chosen to lead others like him to decide. There was never any hope for justice for this child.

Something happens in jury deliberations like this that social psychologists need to study and work with the justice system to identify and remove. Wether it’s an aspect of an individuals’ psychology or an aspect of group/ social psychology, it needs to be identified and removed.

Cause of death is NOT NECESSARY in a trial such as this. The jury was amazingly ignorant of the law and as a result, a murderer walked. Casey must know how lucky she was to get 12 very dumb people to serve on her jury.

You people expect prosecutors to present cases without any doubt but that's not the law. Cases must be proven to the standard of "no reasonable doubt". No case can be proven beyond any doubt without a clear confession and/or a video of the crime. In this case, how is it possible to say that there is reasonable doubt that Casey Anthony had something to do with the death of her daughter?

Posing a scenario here..could it be possible that Casey gave Caylee a dose of chloroform the night before (to go out)& gave 2 much that Caylee had a "hangover" effect the next day. Then George gets up the next morning & takes Caylee to the pool but has no idea about the chloroform.George turns his back in the pool for a few moments and Caylee drowns (groggy and drugged still from chloroform). Each one blamed the other for her death...they both freaked out and the lying began.

That it evaporates and dissolves over time? Was he expecting to find large amounts after 31 days inside a car with the Florida heat? Please.

@cheapy2006 I noticed that too. All the quality journalists left Foxnews years ago when they refused to conform. They wanted to report real news and Fox wanted them to report the news THEY chose. 'OUTFOXED' is a great documentary about the negative turn towards tabloid media that Fox experienced.

Cases are won and lost by jury selection. Point in case. 12 idiots and here is # 11 and I hope he sees Caylee every time he closes his pathetic eyes. Letting a child murderer walk free, may you never never forget the pain your vote caused. A pathetic excuse for a jury, Baez was in sheer delight. I'm still in disbelief over this case and the jury allowing a killer to walk.

I guess I just dont understand casey not completely pushing George under the bus if he did what she claims he did. as much as she lies you would think she could put some of those lies on the "truth". I realize he wasn't on trial, but it just doesnt add up to me.

According to Ashton's book, she wanted to push him all the way under the bus. She told her shrinks that she thought he drugged her the night before then molested and killed Caylee. Her legal team probably thought that was a very bad idea and somehow talked her out of taking it that far.

The state failed to prove beyond a reasonable doubt that the defendant was guilty and the jury made a verdict of not guilty. If you cry babies want to blame someone blame the prosecutor. From what I read and watched the state didn’t have conclusive evidence and the defendant got a good lawyer.
