Canceled for convenience: North Texas family loses home after builder backs out without warning

A North Texas family says they have a warning for anyone who's buying a home from a builder. Just days before closing on their forever home, their builder backed out. Turns out the builder's contract they were required to sign left them with virtually no protection.

    This is an outrage. Sounds like the builder used these people to finance the build, only to sell at an increased price to bidding buyers.

    Even for a new build get a real estate agent or real estate attorney on your side to review the contracts before signing and along the way. Well worth the price.

    *UPDATE* The company folded and sold the Brundages the home at the original price. They also removed any and all "cancel for convenience" language from their contracts. It seems the public outcry actually put their business in jeopardy. GOOD.

    I did some searching and the family finally got their home. The builder removed “cancel for convenience” from all of the contracts but left ALL of the other crap in there. Still absolute crooks.

    It’s not a scam unfortunately it happens more then people know. If they signed contract in 2020 they can’t build for same price in 2022 it’s not right but not illegal.everything is in the contract and to me for the most part protects the builder. Also if your buying in a subdivision price goes up about every third house built so if you buy last few houses you will pay thousands more then the person who bought at the beginning. Plus all these investments companies are causing a problem in the housing market inflating prices which is going to ruin the market and make it harder for the normal people to buy

    There are a lot of comments that as unfair as this situation is, the couple did technically agree to the terms and conditions in the contract... BUT, this point you bring up is great! I hope the couple uses this angle in court!

    @@bnorris8166 it doesn't seem the couple was fully aware of just how immoral and one-sided the contract was and probably didn't understand the terms of condition. The contract is so long and involved that pretty much no one ever has the time or knowledge to reads it which is why someone is there to explain in one or two sentences what is on every page that you're signing. They gave a quick and insincere explanation as to what could happen and blew it off as no big deal and nothing to worry about because it's extremely rare. Hopefully the judge will see through the lopsided contract and award the homeowners

    And the buyer holds no responsibility? If any adult refuses to hire legal representation, like these did, then they get whatever the perps throw at them. Buying property is not like buying a car. Every buyer needs their own realty lawyer. The sellers come up with all kinds of crap when they know you're not lawyered up. Welcome to America. Now go back home! 🖕

    There was an update video at the end of 2023 that says the family eventually got the home and all the language about being able to cancel for convenience has been removed from the builder's contracts. FYI for anyone: contracts are not allowed to be so one sided. If one side can cancel for any reason then typically the buyer can also cancel for any reason. Contracts must be balanced or they can be voided.

    No, those clauses should definitely be enforceable. Read these contracts closely and have an attorney review it. The buyers' hope here will be promissory estoppel and restitution.

    For the company to say that the rising cost of material is what caused them to cancel the contract is totally bogus considering they purchased all the material need for the house at the beginning of their contract.

    Sounds like those home builders were scammers pure and simple. My dad was a home builder in the 60's and 70's and had a great reputation and was highly respected. This company is disgusting. I hope this family gets justice in the end and people looking to having homes built in this area run screaming away from these sleezeballs.

    @@SteveBluhm you can tell it was a scam in the messages directing them to sell their house. The builders simply added at the end that they were no longer honoring parts of the contact. That was their first attempt to breach the contract at buyers fault. Once that didn’t work, they ended up breaching the contract anyway. They also bought themselves plenty of additional time when those ppl should have been moved in. I’m sure there’s more evidence. The family will probably win the court case but they were certainly scammed out of their dream home 🏡

    The majority of contracts with home builders give them the right to cancel the contract for no reason. It’s weird that no politicians have proposed any laws to make changes to how these contracts are drafted. What’s the point of signing a contract if the builder is allowed to cancel just because they feel like it.

    It totally looks like the builder is scamming people. The builder is going to get a bad reputation for doing this to people. The builder is a scammer plain and simple. No respectable builder would do this to a customer. Also any honest judge would throw out that contract because it should be considered illegal because it doesn't protect the customer.

    Work with a reputable builder and ensure that you challenge and rewrite the contract. Also, if you can, pay the upfront deposits that lock in a contract with steep penalties for their cancellation - so that you profit if they renege.

    The biggest red flag is the builders requiring the previous house to be sold. What business is it of theirs whether they keep their previous house or not. If the new house is paid for that is the end of it.

    So the builder used them to get the house built but when it was time to close they check the current market and if it has changed to allow for a greater profit than they give you your money back and take the profits, if the market is still the same or worse they close and take the profits originally predicted. Convenience is what ever allows them the most money. You selling your home tying up your money and your inconvenience does not mean any thing. These builders should never work in Texas again.

    As I thought more about this situation the judge should rule against the builder because it is absolutely absurd to force someone to sell their existing home only to then cancel the contract. Hopefully somebody within the chambers can see through this because it just isn’t right. Smells awfully fishy to me.

    Sure. No trial though, they signed that away. So it's off to arbitration and of course they will win. They also agreed to the settlement already, $500. All the bases are covered on a civil court level. Contracts are binding. They should have sought legal advice before they signed, and they declined it, and initialed it. They provided labor to the project by selecting the textiles, as well as designing a custom pool. So a labor lein could be sought, except they waived that right as well. The only thing left is if they can prove something criminal by the builder.

If this company has a pattern and practice of luring and seducing first-time minority homebuyers then I would imagine it would invoke numerous federal civil rights statutes and they could no longer hide behind the "But judge, it was in the contract they signed!" bs.

    A similar thing happened to my wife and I 16 years ago. We signed a contract, paid earnest money - chose our finishes, elevation etc., - About a month later; the builder comes back and says “If you want this elevation- it will cost you an additional $6,000!” Instead of fighting it - I got my money back and we found another home. Which actually worked out better in the long run for many reasons. I’d put money on this that like this couple; we are a black couple and this happens more than we know of.

    Always read those contracts to the tiniest details especially when it's something big, like a home or car. Ask to modify the contract to something fair. No deal? Just move on since there's millions of homes and cars for sale with much sweeter deals. Also, if the home is extra cheap from specific builders that could mean a red flag.

    They were held hostage by a contract. I've had the same thing happen to me, in my experience you will not win the case. I struggled with depression and suicidal thoughts after having my savings taken by a one sided contract just like this. I tell my story in this comment with the hope it is used as a cautionary tale that others can learn from. TLDR: Do not let salesmen sweet talk you into signing contracts without intensive research. I repeat do not trust salesmen on their word.

    So sorry this happened to Joshua and this young family also. 😟 Read everything, including and especially the Fine print. Never sign contracts or anything without reading what you are signing!!!!! The contents of the contract that were highlighted in this vid were huge red flags. Always have a Real Estate Attorney look over your contract, especially when there is a project of this magnitude. I hope all works out in this family's favor. 🥺

    @@georgina4874 I did not get a refund, they had a no refund policy and canceled my contract after trying to hold me hostage for even more money. They said that to continue the project they would need payments of thousands of dollars. I had no idea they would ask for multiple payments after I had already contracted them and paid them very well. They said I would have to make the payments for the project or they would cancel it and I would be left with nothing for my investment. This was after I had already poured my savings into it.

    Ugh. That’s insane. The builder completely took advantage of this family. Lawyers are often not trustworthy either! You need to hire a second lawyer to read the agreement you sign with the first lawyer! It goes on and on and on. The world is full of people ready to take advantage at every turn.

The company made them sell their original home and then at the very last minute canceled the contract for THEIR new house and the reason is so that the company can sell the house for more $$$ to someone else?

    They should be investigated to see how many other potential buyers they’ve done this too? I have a feeling it’s all a scheme in order to stick a homebuyer with the cost of building the actual home. Only to then cancel the contract last minute, after the house and everything is built, to then be able to list it on the market for a substantial amount more. Which is exactly what they did to this poor couple. Something definitely doesn’t seem right with that contract either!

    @Tah BOO true but no one forced them to sign the contract or hire that builder. I think most of these contracts are predatory and that a lot of builder have started doing this to actually gain cheaper construction financing for the house knowing when they do this they can make substantially more by selling on the free market. You can bet if the house market crashes they will not do this and will force the buy to go through even if the house is now worth less than it cost.

    My ex girlfriend worked as an underwriter for DRhorton and she would talk about how the company would approve people for loans and land etc....and they would then postpone the dates for two years, until the paperwork expires, and they require you to apply again. ,but now for the house loan and property together, vs. Separate as they originally were. They then would tell you that you weren't approved, because of the original loans now on your credit. They deny you the new loan, you dont get the house, and it's on your credit. But they turn and sell it for twice as much. It's a scam! It's a scam! They use your credit to build the house and have no intentions of selling it to you. It was a plan theh had all along. It literally just happened to a house down the street.

    This might be true, we bought a house a year ago with them, when we walked in their office they told us there’s a house that just got canceled, the buyer did not qualify. I wondered why last minute cancellation coz the house was almost done. They told us the house has not been put back in the market so you gotta act fast and sign the contract. We closed within a month. Now reading these comments and from the video am speechless 😶

    There needs to be a follow up to this story. this is outrageous. Companies hide damning clauses deep in the contract and not everyone would read through it. Also, I am pretty sure the builders would have pressured the family saying they need to sign the contract in a day or they have other families ready to buy, leaving virtually no option/time to seek an attorney. And further, if an attorney would have been sought, the builder would have simply found some other gullible buyers. In the least, the builder needs to pay interest and equity loss for the money they held for over a year. Some punitive charges to prevent this from happening again won't be unreasonable. Finally, a full page advertisement in the local news paper would be great too so that other buyers and builders would be aware.

    Ethics is rarely a characteristic with Real Estate developers. The bottom line here is they valued money over honoring a deal. The market grew so much in the time it took to complete the house, that they knew they could make a whole bunch more on it. Which would be fine if they didn’t have ridiculous requirement in the contract, like you are required to have your current home sold by a certain date.

    There should be a standardized contract for all builders unless otherwise spelled out to the buyer. The builder should have to explicitly explain every clause that doesn’t match with that standardized contract.

    Folks, as a real estate agent I can tell you confidently that ALL builder’s contracts are in the builders best interest, not the buyer’s. They don’t negotiate the terms either. Especially not in a sellers market. If you want to build, you are at their mercy. Period. Now the thing that keeps most of them somewhat honest is this right here…bad publicity. But there are no guarantees. You’re honestly better off finding an independent, skilled, well recommended contractor who will GC your build and use a skilled agent who is very familiar with new construction to negotiate the contract using a TREC promulgated new construction form. Don’t go it alone folks, good agents are worth the investment!!!

You obviously have your opinions and I’m not going to change that but agents do a lot more than you described and advocate for their client’s best interest. The average person doesn’t know the first thing about contracts and what their rights are. You can also hire a good real estate attorney but they don’t have negotiation skills or an intimate understanding of the market in real time. Either way, just don’t do it alone! You should NEVER sign a contract without a professional advising you, especially a builder contract!

    This has been happening a lot... because Builders, with the market blowing up, know they can sell the house for more than what people have already agreed to pay for it... it's despicable. "Cancelling for Convenience" ...(can make more if we sell to another buyer).

    This is happening everywhere. All builders r doing this. Cash buyers with deep pockets is why. The pandemic made this happen. These people signed a contract and will lose in court because what they signed. The builders knee these people probably couldn't qualify for the increase in price. Even private homeowners r adding this to sale contracts. The market isn't good for conventional loan buyers now.

    Always take a contract to a paralegal who specializes in contract law, or at least a lawyer who specializes in this (paralegal is cheaper, but cannot advocate for you).

    This is absolutely disgusting, so basically they have this family foot the bill to begin the construction of the property and use them as a hedge through the entire process. In the event property prices decline over those 18 months it doesn't matter the company will make their money as stipulated by the contract and in the event property prices climb up they just cancel the contract and put the home up for sale on the open market. For the developer this is a win win, there's little to no risk. This type of practice needs to be made illegal and I can't believe it hasn't already.

    I used a DFW/national builder to build my home. I don't recall this language in my contract and I was thought I was meticulous in going through the contract before I signed it. It gives me chills to think I may have missed these clauses.

    In my opinion, Yes! Home prices have increased exponentially in the past 18-24 months. I recently read about another home Builder who increased the price over $100,000.00 near its completion. Had it worded in a tiny clause. Forked tongue serpent unethical but I guess legal because it was in the "con"-tract.

    This couple helped the contractor complete the house for a $300,000 FLIP profit. If the judge doesn't consider this Predatory "lending" practices, the Couple MUST initiate a Federal lawsuit.

We couldn’t understand why the salesman insisted on us not buying in that area, well when we drove through the subdivision again, we realized why he wanted us to move more south.     I hear you but, from the story told you have to think about it like this. The couple were already spending money monthly on Airbnb...(after selling their original home) who knows the amount per month. plus they're adding a swimming pool. The home was being built...They had no ideal. If they paid that $2K they would still 'be out of luck moving in their home due to three words: "CANCELED FOR CONVIENCE"

    @@mssha1980 maybe I wasn’t clear but the purpose of the lawyer is to review the contract BEFORE you sign it. The lawyer would have pointed out all the high risk clauses in the contract and would’ve recommended the family NOT sign it, find a different builder or ask for those clauses to be removed. All of this would’ve taken place BEFORE the family even agreed to sell their first home saving them from all this disappointment. Hope that was a bit clearer.

    @@kjlawrence2497 maybe I wasn’t clear but you don’t pay $2K to have a lawyer review your contract after you sign it. You pay them to review it BEFORE you sign it. Had they done this the lawyer would’ve immediately spotted the “cancelled due to convenience” clause and warned them NOT to sign it, ask the builder to remove the clause and if they didn’t they can find a new builder. Remember you have the right to have a lawyer review any contract before you sign it. It may save you from disappointment later.

    @@charliej766 I understand what you’re saying. The real estate agent is the one who could’ve explained that to them and added an addendum. But…. Those contracts are pretty much as presented as is and in this market ‘take it or leave it’. A lawyer would’ve been a waste of their money.

    Outrageous ! They purely wanted to wear the buyer’s out with multiple delays and changing the closing date and when that didn’t work they used that horrible clause to sale their home for more money! I pray this family gets justice!!!😡

    I'm sure every contact on a new build with them is like that. That contact covers all there bases. The family signed it with all those contingencies stated. Heartbreaking for the family but that builder covered

    That is messed. Im sad to say this is happening more times than we will ever know. Builders can get away with pulling this crap. At one point cunstruction workers can even come for homeowners if their boss didnt pay them. READ THE FINE PRINT ON ALL CONTRACTS and check the bbb for contractors credentials.

    It's not an unfair question but it looks like in this case the builder entered into the contract to get the house built and then exercised their loopholes and options to bail on the contract because the market had changed and they were able to get 300k more. It remains to be seen how the judge will rule on the legitimacy of the contract.

    It has nothing to do with them being black. The fact is the real estate market is up in a substantial way and the company was building a home in 2022 for probably 2019 prices. They looked at it and figured they could make a lot more money to take it and sell it to someone else at 2022 prices. In short, it was 'convenient' for them to do this.

    Yes it is an unfair question, because if you were listening, it clearly states that they took the house from the new owners and sold it for 300,000 more than what the new owners were going to pay for it. It's all about money.

    The nice upper income family has the option of paying $300,000. more, and chose not to. And I wouldn't either. I'm the type of guy who would commit a felony in the middle of the night, wearing a disguise to protect me from video, and leave my trackable cellphone next to my bed while I burned the house to the ground.     This happened to us. We had a contract to buold a house on a specific lot in a community. After months of one excuse after another, we decided to drive to the community which was over an hour away. We got there only to find they had actually built another house on OUR lot. Through discovery when we sued, we foubd out that they persuaded every other customer for that community to buy another one of their houses in another community. We were the last holdouts. Why did they do it? Because another community opened up within sight of oyrs and that builder's entry level price was $100K HIGHER. They basically LIED to all if us, saying there were delays in getting permits, etc., when, in fact, this was clearly not the case. Just like this family in this video, we sold our house because it was our end of the deal. The builder knowingly left us homeless. We ended up having to start from scratch and continue to rent while we built another house ourselves. These builders are criminals, IMO.
