NY Medical Malpractice & Personal Injury Lawyer Gerry Oginski Explains

You sued your doctor for medical malpractice.
You think he was careless.
You believe his wrongdoing caused you permanent harm.
A medical expert we hired confirms your belief that you have a good case.
During your lawsuit, you will be questioned by the attorney who represents the people you sued. This defense lawyer will ask you lots of questions. Questions about what happened. Questions about conversations you had. Questions about what injuries you suffered. Questions about how your injuries affect you on a daily basis.
This will take place in our office.
In our conference room.
There's no judge present.
There's no jury present.
Instead, it will be just you, me, the defense attorney and a court reporter in the room.
The answers you give represent your sworn testimony.
But you're a private person.
You don't like to share information.
You don't like to tell people your private business.
You don't like to tell others about your medical issues.
Well, a deposition is THE time to do that.
You'll have to share that information with the defense.
You'll have to reveal private information.
But what if you REFUSE to disclose embarrassing and private information?
"Mr. Jones how many times a week do you have sex with your spouse?"
"What?? I'm not answering that question!" you exclaim!
Do you have to answer it?

I was an innocent bystander in a medical malpractice lawsuit...had limited involvement with the patient... Little did I know, my answers were to be used against the other defendants... I was used as essentially an expert against my own team by the plaintiff, and my lawyer never warned me about it... I spent TWO days on the witness stand essentially being USED against the other defendants by the plaintiff attorney... My lawyer was pathetic...

And that sounds very stressful, and sneaky but that is the justice system unfortunately. My best friend and I have a small business and we defeated a city who breach their own contract which stated we would get attorneys fees. After becoming the prevailing party the bias judge did not award us $1. How's that for justice?

Filed a 42 usc 1983 with a federal court . The court does not want to hear this kinda case . Court asked me to write an objections why the court should not hear the case. Wrote my objection in time allotted. How long can the court take on answering objection. If it is not answered, can the court be forced to hear the case . It's been 4 months

What you don't want to do is get trapped in talking and answering to a false narrative that a crooked lawyer is trying to weave. And most lawyers are crooked scum.

@@altha-rf1et If he refuses to answer questions repeatedly during his pretrial deposition, I can use that at trial if the witness now chooses to suddenly 'remember' the answers when before he refused to answer. It's a contradiction of sorts. Plus, if he refuses to answer during a deposition, I can ask the judge to intervene and penalize him for refusing to answer.
