Bringing To Light The Supreme Court's Shadow Docket | Steve Vladeck | TMR
Sam and Emma host Steve Vladeck, Chair in Federal Courts at the University of Texas School of Law, to discuss his recent book The Shadow Docket: How the Supreme Court Uses Stealth Rulings to Amass Power and Undermine the Republic.
Steve Vladeck dives right into the distinction between the newly dubbed “Shadow Docket” and the Merit Docket - which involves years of litigation, oral arguments, full decisions and is typically what we think of when we imagine a Supreme Court case - and the longstanding reliance on both dockets, the former for routine and expedited cases, and the latter for cases with material and lasting impact. Vladeck then walks Sam and Emma through the revolution that the shadow docket has undergone during the Post-Trump conservative majority, with the Court expediting the Trump Administration’s challenges whenever requested, and essentially ignoring the processes that gave their institution legitimacy in the first place. After assessing the rather partisan nature of the Court’s recent use of the shadow docket, Sam, Emma, and Steve look at the evolution of the docket and the public’s faith in the Court and emphasize the importance of public pressure in delegitimizing this institution.

There is so much information here I’m going to have to watch this a few times, to let it all soak in.

Yep! This show is pretty much how I decide what books to read.
This was very informative.
I like this dude’s voice
Living on this planet at this point in time is like previewing a prequal to the Hunger Games.
Someone help me understand something, perhaps I missed it, but the guests claim that the “high watermark is behind us” seemed baselessly optimistic. Without any tools for accountability I’m not convinced there’s any good reason to believe they won’t act unfettered in the future, especially if a type like DeSantis gets in.
Thought it was Andy kindler in the thumb nail

Smells like Scrotum-!!! Except that the High Court is much less useful.
What power do the people have when a court becomes anti democracy?

Better question: what power do the people have when their elected officials parrot the elite and do what's profitable for the elite? Even Democrats. The entire system we call "republic" is anti-democratic. It's merely just the next half-step away from feudalism, giving the masses the illusion of democracy while still maintaining it for the few at the top. "Republic" in the traditional sense is better described as "elective authoritarianism," "feudalism with elections," or "mob rule, where the mob is allowed to vote for who will rule the mob (from among a selection determined by the elite)." When people say things like "protect our democracy," they really unwittingly mean "protect the 'elective' part so that we can maintain the illusion of control."

@@Nutrollio I don't have an agenda other than fairness for the whole nation. Why is Thomas racking in million Dollar bribes. Why did the last Justice's lie to get on the court. Why did the Republican party have to cheat to get a supreme Court nomination. Get a clue. God well burn you to the ground.. I want to see all of them in front of St Peter. I am now waiting for your fake laugh. You will burn with them. No their lies will not save them. It will condem them.
Thanks for bringing Steve on.
they teach us of Julius Caeser taking advantage of loose definitions of "emergency" and yet they are too stupid to react to this eventual outcome with alacrity.
