Seems you are confusing a K9 “walk-around” with a search. The Supreme Court has ruled a walk-around is not a search under the 4th Amendment as long as the dog is legally situated (just walking around a car). In a walk-around, there must be a “hit” in order to produce probable cause for an officer to enter the vehicle and search. THIS, however, is ALREADY a search, a boarder search to be precise. The officers are already searching the vehicle and no “ hit” is needed to search any compartment. They are just using the K9 to make the search easier and faster.

You have to be a full blown moron to think a human is going to find something a trained dog doesn't. The dog doesn't even need to be in the vehicle to get a hit. The agent is just being a douchebag that serves no real purpose in the search and has no reason to open anything the dog just sniffed. Anybody wearing sunglasses and using a flashlight to search a vehicle his dog just sniffed is a full blown douchebag that should retire his dog if he doesn't trust him.

@@truthbeknown23 You probably should pick an argument with someone on the opposite team. I was simply stating that it seems myopic to claim that a redundancy is never effective. Your statement connotes that the dog is infallible. There is an old adage " four eyes are better than two". Having said that... I'm not a fan of having a dog with its dirty paws all over the interior of my vehicle to satisfy an officer's suspicion. Clearly, the officer was displeased with the dog's findings, and exposed his lack of faith in the dog's ability by searching for himself. At this point, some officers get so frustrated, they "introduce" evidence. Now ya see? Barking up the wrong tree my friend.

Christopher M dogs you said they were using teamwork in response to my comment. That's not teamwork. That's a douchebag agent roaming through private material that the dog didn't pick up a scent on. If the agent doesn't have faith in their dog(like you pointed out) then their search is pointless unless they disassemble the entire vehicle. Dogs dont use their eyes to search, they use their nose. It seems you've pretty much proven my point by saying the agent didn't have faith in the dog. If there is no faith and he thinks he can find something the dog didn't then the the dog isn't needed. The officer introduces new evidence by getting frustrated? Getting frustrated is evidence that he's not qualified for the job and nothing more. Thanks for proving me right. I feel like when the first officer came in he was looking to do something. Then he realized the camera and got shook

They can do that shit and get away with it, why they became cops in the 1st place. If they were liable for shit they fucked up on bad searches they'd never search anything. I quit carrying a wallet to deprive them of 1 thing to tear apart. ust DL and Credit card in separate clear plastic sleeves. AS far as them tearing the car apart, you can't stop them from doing anything they want to do. Cops is Dallas had traumatized me so bad I would start shaking uncontrollably if I saw more than 2 of them at once. I moved back to Detroit and never had problems with cops here ever.

THEY DESTROYED A GUYS HOUSE WIth BOMBS to get a shoplifter and the court ruled the police didn't have to pay for shit. Edward Elric I think the point of his comment is if they stopped him and did a random check and a dog put holes in his seats he'd be pissed as would any human. second of all tons of people pass the borders with no check and there isn't car bombings in residential areas targeting single houses (as far as I know anyways???) so you example is kinda useless. and anything with attacks like that is usually citizens of said country and they would not risk transporting goods of that sort across the border as it would be to easy to catch if they did come across the border. obviously they are searching it for the security of the country but that dosent mean they have the right to damage a vehicle with no repercussions.

Asking you for 4:54 of your time to enter this country is no where near to long , I'd even go as far as saying up to 15minutes is not to long. It's to keep these dangerous drugs that people are stabbing each other and shooting each other over, and then the robberies and all that of course that's only in places like Los Angeles,Chicago,Philadelphia,New York City,Detroit to name a few. Im out in the mountains away from all that,sounds terrible though.

Youbones 1. They're outside (Or at least in a place where the sun is beaming on them), do you expect them to take their glasses off every time they lean in or get in the car? 2. Taking your glasses off doesn't make dark spots under seats and in between seats & consoles any easier to see. 3. IDK, I was driving a rental car which is what got me stopped at the Canadian border. I rented the car to see the fireworks from their side BC it's safer, the rental car had Indian plates, the customs guy asked me why I went to CA, I told him, he said "you came all the way from Indiana to see the fireworks"? "No it's a rental", OK pull over to the 2ndary search lane right over there. MFers pressed me FLAT against the wall and the one guy was feeling IN BETWEEN my testicals. almost like he was thinking to himself "Here's the left on, here's the right one, no wait, left one, right one wait I lost count, gotta start over..."

It's possible to become a member of some Web sites where your video automatically is uploaded immediately to the Cloud. Even if they get the camera, your video up to that point is already unreachable to the searching officers.

if it was my vehicle id be pissed, i keep my vehicles very clean, and i like them without scratch marks all over the platics and leathers seats, i understand why they use a dog, but dogs , no matter how big or small, can damage your interior plastic and leathers seats

It's really sad how they felt the need to want to find something to send a dog in there not once but twice to destroy that car. Also if anyone else didn't hear whatever was happening in the back of that camera it did sound like buttons were being pushed so wondering if they were trying to turn the camera off. There's absolutely no need to destroy someone's vehicle like that they didn't find anything the first time they're not going to find anything the second time and they're sure as hell not going to fight anything the third time

Dacrazy-can you do. I had it happen was told it can buff out and the interior was not damaged by the dog it was due to driver neglect. Then was told if I didn't have weed in my car I wouldn't of been stopped... the dog hit on nothing in my car but according to the chief of police they were in the right because the officer smelled weed in my car, they were pretty silent about the dog not smelling it.

Pete Hines its pretty simple. the foundation of our legal system is a warrant. a warrant must be supported bu specific detailed articulable information. probable cause. a dog can not ever be valid pc because it can not testify in court and be challenged. it can not be specific and it can not articulate anything. it should never be allowed as pc.

A friend of mine Won a suite against a department because they had a dog wander all over inside his car. he's seriously allergic to pet dander and told the officers several times he was. they ignored him. Mocked him about being allergic. Sent the dog in several times for no reason. Never found anything and then told him. You're free to go. He said he could no longer enter the car because of all the dander, the officer mocked him again saying, My dog perfectly clean. my friend called his lawyer who came to the scene. lawyer spent several minutes collecting information about the officers and exactly why they searched his car. In the end, he had to call a tow truck to have a car hauled to an auto detailer. Spent in the area of 1500 to 1600 to have all the seats, carpet shampooed, interior almost completely disassembled for a deep clean and even had to have the seat belts removed and cleaned. They completely cleaned everything. he had a recording of him telling officers of his allergies. the dog crawling all over the car multiple times. how the officers mocked him. Yeah it was pretty bad.

Why aren't they using breeds like beagles which are the best for being sniffer dogs?

Officer: "Let me check underneath the papers in the middle console, there might be a Mexican hiding under them. " 2nd Officer:"Let me double check the middle console, those Mexicans are sneaky."

The only alert the dog showed was when the officer clearly gave it a hand signal to do so, and even then it didn't stop long enough to have found anything they were sniffing for.

I feel the pain of this poor dog who have to live with such idiots lol.. I have 2 questions: 1- imagine if this guy had a nice BMW 7 series with a beautiful brown leather and a great rear Tablet between the seats. this dog will just scratch every shit in the car, how the hell is permitted to get a dog in a personal car like that? 2- imagine if the owner of the car is allergic to dogs, or a member of his family (wife, children, etc.), how the hell the law allow them to search like that a car with a dog that will put his hair everywhere? a dog doesn't need to enter a car to smell anything that he's trained to smell, what the hell are those laws?!!

If you don't consent to your car being searched they can bring in the K9 w/o a warrant (please correct me if I'm wrong). But then If the dog doesn't get a hit (meaning that the K9 didn't identify the scent of something that he was trained to pickup on), there's now no probably cause, there's still no consent to search and no warrant...so at this point isn't the vehicle search performed by the two agents illegal? If the vehicle is legally registered and insured in the US and the driver is a US citizen with a valid driver's license (and yes, with regards to these I am making the assumption that this is the case) he's protected against illegal search and seizures across the board, period. Doesn't matter what agency.

zeke They are allowed to do an exterior sweep with the K9. If the dog "alerts" then they are allowed to enter and fully search. However their loophole is simply saying the dog alerted so they search anyways. If they want to get in your vehicle they will.

I believe a way to fight the dog just alerting or so they say. you need to ask them what is the dogs signal to alert it has found something. they have to tell you then you can watch as well it's not much but it helps if they have to tell you the signal the dog shows

It was a very difficult thing to find in the grainy video footage from the officer's dash cam, but i was recording 1080p quality footage from much closer and from almost the opposite angle with a pair of $30 camera glasses i bought from banggood.com. and the hand signal was clear as could be, but it was, indeed, very subtle. The officer wasn't worried in the least about making the signal in my sight, but positioned himself so that his body blocked the signal from the dash cam of the car that initially pulled me over. That is why it was so hard to identify. They had no idea about my glasses, though, the fuckers. I didn't say anything about my video footage all the way through the pretrial process while the d.a. kept offering plea deals that i declined. Finally they made an offer the day before the trial date and told me "its not gonna get any better than this. If the jury finds you guilty, you are gonna get a gazillion years and blah blah blah." So i made a counter offer. I pulled a $20 dollar bill out and held it up and said, " How bout this: Here's $20 bucks if you just go away." The guy looked like he just watched me take a dump on his treadmill, mouth all open, big uncomfortable pause. Lmao! Finally he stutter/stammered "I can't do that. No way." I said, "Sure you can. You do it all the time." He said no again, so i held it out closer to him and said, "It isn't going to get any better than this. If the jury finds me not guilty, you're gonna take a loss on the record and destroy your 100% conviction rate. You know that, right?" Desired effect achieved. That fat fucker's face nearly turned purple, he got so mad, lol! We went to trial alright, and he thought he was gonna bury me with a slam dunker case. Arrogant as i've ever seen anyone. Swaggering around like it was his courtroom during the jury picking process. The second the jury was seated, i entered the video footage into evidence and long story slightly less long, i was found not guilty. The lackey deputy d.a. was shitcanned for fucking up the 100% conviction rate of the d.a. office. That's how you punch back.

He's like thinking in his head "Oh shit I'm on camera 🎥 I better get the fuck out of this vehicle 🚗 😳 " haha 😂

I cross the border constantly and get this rivisions frequently because im a young mexican driving a mercedes. If you speak up that theyre damagung stuff they put you in a cell for your own and their safety. bunch of bullshit.

That dog scratched the shit out of that vehicle, how could someone let that happen? They consented to a search, that's how.

Just what are they looking for? They put the dog in, but it doesn't hit, so they leave. They come back and put the dog in again, but it doesn't hit, so they leave. They come back and do a manual search, but find a camera filming them, so they leave. They come back again and do another manual search and still don't find anything.

I'd be pissed if a dog ran around in my car like that. Dogs can't retract their claws, damn animals! :) And yeah, that is Rick Moranis' lost brother!
