Border Patrol called by Property Owner and then I'm put in handcuffs; Langtry, Texas

Approximately 9:30pm, Monday, Nov 25, 2019 M Arrington stopped his truck, which appeared to have the identification for the US Customs and Border Enforcement artwork upon it. Arrington approached me and described a call that he received over his radio of a person with a flashlight in the area. So, an investigation of me was initiated and I cooperated as best I could with information that I thought was relevant to clearing me from any suspicions of illegal activity. However, it turns out that I was the "person with a flashlight". I was the suspect. The property owner, who called, identified themselves during the call.
When I asked for Arringtons "credentials" in exchange for mine, I became uncooperative and was placed in handcuffs. Arrington explained that he called for backup over the radio. Another Border Patrol agent, ?, arrived then we waited for the Sheriffs Department deputies (who never came). We talked about justice, events that occurred before the call, and past experiences, and the area.
Arrington dug deep for a crime to belittle me with, which ended up as a trespassing on private property. He is not only a Border Patrol agent, he also dabbles in Sheriff Deputy services and interrogations as well. Since no Deputies did arrive, a pattern of the Border Patrol having to fill that gap becomes an extra service that they provide.
Do our "Civil Rights" extend to the very edge of the US Border? Our rights may get violated even more closer to the Mexican border as a result of the increased tension between the 2 countries. I don't believe this same tension is as palpable on the Canadian Border.

    Whereas I don't even see the joke. The only time I've ever heard anyone tell anyone to sit down when there was no place, is cops on these videos. Who the fuck are the passive little pussies they are used to dealing with? Do they actually come into contact with that many spineless trash?     For a trespassing charge to stick the individual has to first be given a chance to leave. If they refuse to leave then they can be charged.

    Around 5:09 is when the five minutes of Heinzing he received caused the agent to lose all composure, hit the boiling point, his voice started shaking, and he dropped his handcuffs. 5 minutes of a level 10 Heinzing can cause even the staunchest individual to break.

    @Think About It…. If you want to drill down to a granular level, you can make any statement true or false. My statement that a warning isn’t necessary was a generalized response to a generalized statement that a warning has to be given. Bottom line for trespassing is that every situation will be true/judged on its own merits. Never try to generalize law.

If you want to go to altering statements, your statement could be better said by saying , “specifics of the multitude of possible scenarios would be the determining factor of any legal proceeding for trespassing”. This could go on, but you’re correct either way. My only statement was that trespass violations don’t come only after a request to leave.

    Under Texas Penal Code Section 30.05, criminal trespass requires the following elements: the person enters or remains on or in property of another; and without effective consent; and when the person had notice that the entry was forbidden or received notice to depart but failed to do so. Unless the property owner posts no-trespassing signs, he has not given notice to the public that entry is forbidden. And if you're found to be on private property that isn't posted, you must be given notice to depart and then fail to do so before you can be charged with trespassing. More importantly, no officer can require ID to issue a written trespassing warning unless you actually refuse to leave and are free to do so. Ironically, many officers try the ruse of detaining someone and then saying they didn't leave when requested even though the person was still "detained", because the detention wasn't legal. Evil government actors, those.

The fact that you know he didn't need to ID and still asked, and you believe "needing it for paperwork" is a justification to violate the constitution, and this mans rights. That's another issue.     To my knowledge, a property owner has to convey their desire for you not to enter. Verbally, by sign, OR by the presence of a fence, barrier, etc. This agent is wrong to say a crime is being committed by your mere presence on private property.

    Did you consent to be transported to a different location or was this part of the investigation? That is called kidnapping when you're forced into a vehicle and transported to a different location against your will. This could be a lawsuit if you wanted to push the issue. Private property has to be fenced or posted, otherwise, you have free range. Bullshit, it has to be posted.

    Penal code 3802 does not require you to present identification endless you been legally detained or under arrest in the state of Texas . Way to stand your ground Travis .

    No it does not require if you are legally detained...you can't give false information if detained...if your going to quote a law make sure you actually know what it says🙄🙄🙄

    This is amazing. Trav is so good. I'm pretty sure within 50 miles of a border nobody has 4th amendment rights. This is such a great interaction trav.

    Not correct. Border patrol is allowed slightly more authority to conduct checkpoints within the 50 (or 100?)mile radius of the border, but one does not give up their 4th amendment rights within this zone. Essentially, border patrol may establish a checkpoint but they can only stop a vehicle briefly (seconds) unless they have reasonable suspicion of a crime or that the person is not a citizen. Can be very frustrating for those who have to pass through these inland checkpoints, but people do not give up their 4th amendment rights simply because they are within proximity to the border.

    Texas Penal Code 38.02 - Failure to Identify (a) A person commits an offense if he intentionally refuses to give his name, residence address, or date of birth to a peace officer who has lawfully arrested the person and requested the information. You were never lawfully arrested... suspicion is not a crime. But we can make up a charge Trespassing. How bout that? At least the tyrant calmed down. Otherwise, you were gonna take a ride.... Gov't always out to get someone.... #Just OBEY Good Job Travis!!

    They can only arrest him for smuggling humans or contraband. Trespassing would require the County Sheriff's to make an. arrest or write a ticket. With no evidence they won't waste their time.

    If they have not signs posted to warn you that you re about to trespass, you are not trespassing. That's how trespassing works. Then if you fail to leave or return, you are trespassing. But you are not trespassing until warned that you can't be on the property.

    This Border Patrol is getting PAID to go back and forth with Travis. Even after he conscedes that there is no crime afoot, he continues to basically do nothing for 30-45 minutes.

    he said "I feel confident you are a United States Citizen" yet he is still wanting an ID? LOL How much can he contradict himself, especially when he can ID via the plate on the back of the car. I use this exact same technique myself.

    A private road must be posted as such, and before a trespass arrest can be made the owner must contact the trespasser and communicate their wishes.
