BLA flags 'double standards' on Hlophe's JSC appointment

Black Lawyers Association president Nkosana Mvundlela says he finds it unacceptable that the election of Dr John Hlophe to the Judicial Service Commission is being questioned whereas his appointment to Parliament was never questioned.
Mvundlela says it was Parliament, through its processes, that chose Hlophe and it is unfair for people to question this.

    The journalist is one-sided but the guest is sharp and very correct to tell the haters that everything is in accordance with the constitution which they seem to protect now and there.     Hello there The matter is in appeal,and the issue of morality is part of the appeal. The voting for an issue that is on appeal was unlawful by itself.     A great example of something which is morally controversial but legally permissible is the right of women to terminate their pregnancy. Undoubtedly there are many people who hold opposing views on abortion based on their moral grounds, however since the constitution guarantees reproduction rights we need to respect that, whether or not we agree with it based on morals.

When most of us questioned the ethics and the morality of sending an 80 year old Pres Zuma to jail in the eight of covid and in the dead of winter, he (Stephen Grootes) was the one who kept saying, "the law is the law and we must respect the constitution." Today, the same man is saying "not everything is legal, some things are either right or wrong". I am so glad I will no longer have to bear listening to his bias on SA FM every morning. He is Dr Hlophe and not former judge, he's appointed to the JSC as a public representative and not as a judge.     I don’t think morality or morals should be used as a yardstick here, only ethical values or ethical conduct should be a determining factor as to whether one may sit on the JSC panel.

    The same Steven did concede and said, " I am sorry..." (see KZread clip titled 'Steve Motale speaks about why he apologised to Pres. Zuma against ZUMA'). He was was unethical and immoral to do that BUT he is still a journalist today. Why others cannot be allowed while he (Steve) is still being allowed to serve the public?

    Is the impeachment of an individual equals to a criminal record that finds such persons not legible to hold political office in parliament as mandated by his party therefore when they (MKP) was campaigning with Zuma as it's president they had the same problem but Zuma was defeated in court due to the constitutional court ruling on that crime. I have a question in mind 🤔, is Dr. Hlophe a criminal? Is he not fit to hold any office as mandated by his party? Why others are better than others yet they have been found to have transgressed their oath of office?

    There is the Letter of the law vs spirit of the law. In the JSC he will be 1 of 23 & in Parliament only 1 of 400 so the power and influence dynamic is different, Nkosana is not comparing like for like. If someone has been convicted of embezzlement & has done their time, 5yrs after their criminal sentence was completed they can be elected as an MP. According to the letter of the law they can serve in any capacity including to be in charge of the Treasury. Such a person can contribute meaningfully in many areas but It will be poor judgement to put them in charge of public funds. Nkosana hit it on the head that Parliament reflects the moral attitude of the voter. You can create all sorts of laws to anticipate all sorts of scenarios but ultimately it’s the voter who decides who they send to parliament. If voters decide they want a Drake for example to be in charge of a pre-school then it is what it is.
