If some sections are bailable and some are non bailable and accused is in custody, then under which sec bail petition will be drafted? 437 or 439
sir in such regular bail whether the say of the investigation officer or pp is necessary, or not require any sc judgement?.

@@rajeshranga4873 While investigation if police officer has reason to believe that the accused has not committed non bailable offence but further inquiry is needed under such circumstances only such officer can release the accused on bail, if there is no such reason police officer cannot release the accused on bail.
