Purpose and character of use means the manner in which you use the copyrighted material. Say you are using it for educational purposes, you are commenting on it, or reporting on it. Parody falls under fair use because it is considered commentary of the original work. The purpose or character in which you are using the work has value independent of the work itself. Fair use due to the nature of the work is completely opposite from how you describe. The use of factual works is more likely to qualify as fair use, for example using historical or biographical works are more likely to qualify for fair use than fiction. Please, please, please fix this. The confusion could cause people to get in a lot of trouble.

Another good point to referencing old material is it being in the public domain if it’s old enough.
Plagiarism makes it harder for new creators to get a foot hold in theintustry or online‼great video btw‼
as a beginning animator, this is extremely helpful to know. Especially considering that all of my animations have come to mind through listening to music and wanting to just put that music over my animation. Thanks man. you're my favorite source for "how to" all things animation :)

Incredibly helpful. Yet another masterpiece commission from Howard. The effort you put into these commissions shows how truly dedicated you are and how much you care about satisfying the buyer. Interpolating using AI?? Manually finding the vanishing point for every time the camera moves?? What a legend.
Love that you said "go back to nature", I agree wholly. I'm just getting back into animation after a few months' break and just finished a 30 sec short with nature in mind. Keep up the awesome content!

Reposted from another video cuz it was 2 years old. I said I haven't animated and stayed true to said animation for 2 or 3 months now... idk why, all of this, i see animations my friends are making and getting all these views and they're getting better and better. Im not getting better... and im starting to stop animating... I've fallen into the dark void of "i can't ever be as good as them...." i still think that, look at my animations and then i look at an ex friend of mine, we seperated cause we had a disinterest in our humor. Anyways, i see him getting better n better... im proud of him but not myself. Tanooki, another SFM animator, AMAZING person and AMAZING sfm animator. Cool guy. But i try my best to not watch his videos cause it demotivates me cause i haven't had motivation at all cause of my own stupid head. I feel bad for the people who HAVE subbed to my channel cause i know most of them aren't there for my animations, but a meme video i made a long time ago, "peter parker vs the flash school fight scene but with ed edd n eddy sound effects." That BLEW UP ....and nothing else did... i slowly started to lose motivation cause of that video, i wanna remove it so badly, but i just know that there are so many people that love that video. I cant do it. This video made me genuinely cry. Thank you for the video. I still don't have much motivation but your words really touched me. Alot of things you said, i can relate to as an animator more than i do with drawing. "I'll never have the best computer for renders." I do WANT to animate more. But i feel like I've dissappinted so many of my friends cause I've started and almost finished animations just to lose motivation and just drop it and never say anything due to my fear of their dissapointment...

I liked how near the end of the video, while you're explaining the compositing process you implemented a cover of The Beatles - A Day In the Life. It seemed fitting with the overall subject of the video in relation to plagiarism and transformation.

Haha thanks for noticing I didn't want to feel too authoritarian, so it was a bit of a demonstration like - hey look, there is wiggle room. Hip hop remix culture is pretty interesting. Beatmaker distorts a sample - such as the Beatles, then if you feature that track, neither the Beatles nor the remixer is likely to stop you because neither has a leg to stand on when it comes to who owns it.

Ah that would be a shame to give them up cometely. I've been there - sometimes I have been so hell-bent on an idea for a music track I have considered just uploading it to daily motion or something just as a creative release

Earlier this year I saw a reel that copied a couple shots of one of my old 3D reels, about 10 years old, I recognized a sequence of shots and in particular last shot had a very extreme pose that was required by the guides from the client. I always thought that pose was kind of strange (I got to break the rig to achive it). I mean it is ok, I do not own the property, nor the copy gets a remuneration for it. I am flattered the author chose it but I think he could come up with something more original, or make it better, since it has been 10 years I can see a bunch of things I would change now.
I'm currently in a early animation stage, I still animate on a phone💀 This helps me out a lot!

Definitely save up for an iPad if you like the phone feeling. I myself have an iPad & it’s a game changer.
It's always Better to be originated with Cartoons homework projects because it's more better to see Animatiors making their own projects. Lots of animatiors make their work and also i make my own cartoons. there will be Times were we animate a parody show that's from a Nintendo video games and it could be characters so sometimes I see animations in paint or Sprite version animations about gaming characters like Legend of Zelda Mario, Sonic and more and sometimes the gaming music behind it. And some people make like characters from cartoon TV shows but yeah they make it in their own way but still characters be on the video games and TV cartoon shows that's what I've been seeing here on KZread But yeah the most important thing people should not take people's work without permission especially if they copy the drawing the same pictures and animating the characters in the same positions and they've been keep doing that and never ever made their own artwork and yeah they could get in serious trouble and we always learn from tutorials about animation and we try and do it on our own way. those copyright stuff sometimes some people can get away with it which that's kind of crazy here on YT so I definitely agree.

I still remember when I was that, one of my characters (mondo man) makes an appearance in "Mitchell's vs the Machines". When I informed the member of the design team, responsible for doing this, I found that they were too high profile to pursue. I still outed them but it went nowhere. I wonder, how many more artist got ripped off by big name studios and weren't able to do anything about it?

Ello Mate Howard! Uh, I'm creating a website so I can showcase to a college for a chance to receive a scholarship. However, I want to showcase like a coming soon fan film title because I feel like it makes it more dope on the site along with all my other original works. But I mean, is putting fan films on the site allowed? If it's allowed, should I or does it look unprofessional or something. :/

Sounds like a good plan, and given your body of work, I expect you to be rolling in that scholarship dough any day now. If you have a vision of a fan film, I would say go for it. You can always be transparent about it being a fan film if you are nervous about it. Put - fan film - in the title? You should be fine

What means to copy an animation? The anime Chainsaw Man opening copy a lot of little scenes from different references... I mean... copying a pose alone is not plagiarism right? Copying the camera angle/movement... Copying a whole scene from a movie like Chainsaw Man opening made. So where is the threshold? AI can copy an style from an artist without inflicting plagiarism?

By asking me to draw a solid line that is applicable across all media, in all cases, that can be agreed upon by all human kind is asking me to do an impossible task. I outlined as much as I could within the video. This is why I say that animators need to develop their own sixth sense for what is risky and what is safe. What do YOU think about the Chainsaw man stuff? Do you think it's morally right? Do you think it's leaving them vulnerable to a legal threats? Do you think people might like the show less when they find out how much of it was copied? And if you want my hot take on the new AI thing: AI is a twisted Lovecraftian monstrosity created by goons with no respect for art. It is robbing all of us of so much. I absolutely hate it.

I'm not native in english language, so what I wrote was not exactly "asking", neither I was angry or something like that :) it was much more to bring my personal questions to concious. Don't bother to me, sometimes I coment in videos somethigs for me to remember, even puting time markers :D

im a beginer animation creator and i dont speak English that well, but I had some questions left...I'm sorry if I misheard it...What if I will use style of the artist and color palete, but my animation and plot would be different... like in anime... most anime are look alike, but some things are different...

Supposing an artist placed an except of sample music on KZread that was for sale, can I still use it? I'm guessing that if the full thing was for sale then it won't be copyrighted PS: I'm only talking about using the except the artist posted on KZread to promote the full sample.

that sounds risky. If anything i'd say it's the opposite. The artist wants to sell that track. The artist wants you to buy the track, and the only reason they have provided the preview is so that you know what you're getting. They don't want you ripping the preview sample to use in an animation without permission. The GOOD news is that you know what the artist wants... MONEY. Offer a deal. Either: offer to pay a premium one-off fee for the rights to use the track (even if it's just the sample section) OR offer to list the track name and purchase information int he credits of your animation - which leads to the artist getting more traffic and purchases. The artist is wanting, so the artist can be negotiated with. You spend money, but you gain a valuable contact: someone who can make good music.

Welp i just got banned from the animation guild discord for taking down a AI art defenders character. Shame you can't call scum scum these days even if you make a careful logical and thoughtful case as to why they're scum. I think I'll make a youtube video on the subject because the general consensus seems to be that even though i have every right to be angry, that i have no right to express that anger. AI doesn't mishmash things to produce the result. It generates it from noise. It's the same as an artist studying references and then creating an image from the noise in our minds

No, it steals images and uses a program to determine shapes to be taken out before Frankensteining it into a set pattern with filters applied over it. It is thievery on many scales. An artists takes inspiration and learns techniques, modify and blend aesthetics and structure through hard work and knowledge and interest. TL;Dr real artists are chiefs take what they learn and create cakes, steaks, vegetable soups, chicken Satay, so on and so on. AI prompters only make Arby's.
