Australian Consumer Law - Risk Management for All Business Types

The Australian Consumer Law (Replacing the Trade Practices Act) regulates the supply of goods and services to consumers in Australia and a “consumer” can include another business. Fundamental features of the ACL include mandatory consumer guarantees, prohibitions on misleading or deceptive conduct and unconscionable conduct, and unfair contract terms (including in terms of trade). A business must be aware of and comply with these requirements and educate relevant personnel as even an inadvertent breach by a staff member can expose a business to liability.
