Please correct this from 6:30 to 7:00 Appeal is provided against both the decrees i.e. preliminary as well as final. However, if against the preliminary decree appeal is not filed then its correctness cannot be questioned in an appeal which is preferred against final decree as provided under Section 97 C.P.C

As u said that once a party who fails to appeal against preliminary decree can't appeal against final decree in the suit. Is it the same wording of the section 97. I got confused. I read it as if preliminary decree once not appealed atonce it is delivered it can't be maintained alongwith the the appeal against the final decree. Plz clear it

I differ from what you said from 6:50 to 7:30. An appeal can be preferred against final decree even when an appeal was not preferred in preliminary decree by which party was aggrieved. But in such an appeal (from final decree) party cannot dispute the correctness of that preliminary decree by which party was aggrieved but had not preferred any appeal.
