    The Plaintiff case was dismissed because the DNR paper was not signed AND COMPLETED. The defendant had a letter from the daughter thanking him for saving her mothers life. Judge Ross told the defendant he did the right job and thanked him for his service.

    It didn't show the end, so it wasn't clear what the verdict was. However, since the DNR was not prepared in advance and was not on file, the EMT had no choice but to resuscitate. If he had not, he could be sued for negligence. Also, If the daughter was really desirous of honoring her mom's verbal wishes, she would not have called 911 until after her mom passed. I would have ruled in favor of the EMT who did his job admirably.

    I just watched this and it broke my heart. My mother also had a DNR when she had a seizure in front of my grandmother. My grandmother was in an obvious state of panic watching HER daughter seizing, so when paramedics got there, they got my mother breathing(she stopped). Altho my mother had a DNR (unknown to paramedics at that time), had they not got her breathing again, i never would have seen her alive again(i was in a different state when it happened). It was discovered that my mom had stage 4 terminal cancer that we were ALL unaware of, to include my mother. She was in hospice and i had my time to love her and say goodbye. We honored her wishes for a DNR afterwards, and we lost her a couple months later. its been 13 years and this story made me real emotional. U have a daughter who has no father in her life. youre her only living parent and i dont understand how you could, as a mother, WANT to leave her with NO parents. I dont wanna say it was a selfish move cuz i can see why youre tired of dealing with this, but why not want/need to stay alive with your kids and family for as long as possible??? she cant lose u too! im thrilled youre still here to live another day for your daughter.

    I was in a coma for over a month Dr's said I had less then 15% I would wake up. Then, when I did I would never walk or talk, feed myself, etc. Now, I am in my mid thirties with a wonderful life yes, I have a few issues. I have T.B.I. but the positives outweigh the negatives. I am college educated, married for almost 15 years and a mother. The scary thing to me is, if my Mom listened to the Dr's I wouldn't be here. And my beautiful kids would not be here They kept telling her to take me off of life support. Where I was, the Dr's could (cannot now) take the next of kin to court to take the person off of life support. My Mom won, obviously. Praise God

    Being a person who lives in Chronic health myself and having strokes before 30 i'm all for you keep going as much as possible, as long as there is a little bit of breath in my body i'll keep fighting..I'd find it really hard to be that daughter standing by my mother saying someone was wrong for saving my mother, if she knew her mother had a DNR why on earth would you even call 911, and if one felt so strongly with it why on earth wouldn't you have already filed all the paper work.

    Ole' MacDonald: Thank you so much for your comment. I had the case recorded professionally and you tube only allows me to post 15 minutes. I couldn't edit it and give everyone the answer. So many people have asked me the same excellent question as yours. Here is the answer. I felt the judge was truly conflicted, as you can see from the expressions on his face. I ended up losing the case and told everyone I would have some soul searching to do in the future.

    The plaintiff should of gotten her affairs about the DNR done long ago, If you feel you dont want to live your life like this its your fault not the EMT for doing his job.. It shows you for a woman who has a heart condition and does not want to be revived you should of get your shit together and quit blaming everyone else for your mistake.. You dont want to live like this then wear a bracelet or necklace engraved DNR, its that simple and next time you have a cardiac arrest the emt will know this...IT IS THAT SIMPLE & EASY

    Knowing IRL what it’s like to have a DNR executed at both my parents wishes for my mother who suffered from Alzheimer’s disease, my admiration for this case goes to Judge Kevin Ross for adjudicating this in favor of the very professional defendant. In regards to the plaintiff, I believe her case brings to light that her blessings on this earth are not complete, yet. Faith, Hope, and Love are intangible realities in human life that are not cognitively visualized or verbalized. In all things give thanks. Encourage Goodness to win in your Life and from your Life.

    Absolutely disgusting. Rather than thanking the man who gave you the opportunity to live, what do you do? You take him to court and make an absolute disgrace of yourself. You should be mindful of the type of karma you're sewing because this is new type of low. However I'm glad to see you're still alive and happy. I really hope you learned a lesson from this because it's taught me something. Don't be so critical towards others despite your own personal beliefs and desires. A good person pushes their own feelings aside to benefit others. God bless you and live strong.

    Morals or not, if the Paramedic or Emergency Medical Technician didn't do CPR or give other forms of medical attention to the Plantiff, and Ms. Tanner died, he would have been charged with Negligent Homicide, also known as Criminal Negligence Causing Death in Canada, or Manslaughter, and he would lose his job. Furthermore, the Defendant's employer would have been sued for Wrongful Death. Spare me your religious beliefs and be grateful that you're alive as "life is a right", once you pass away, you lose that fundamental right.

    She should be giving him $10000. Had same condition since a child. She should have her wishes written clearly YEARS AGO. If he had let her die with no written consent.. He would have been in a lot of trouble.

    The old lady is fighting the wrong fight. You “want” to die but when the gun is in your hand, you are afraid to pull the trigger. Conflicted on what you feel is the right and or moral thing to do, whether that is to keep on fighting until nature officially takes its course or to take the easy way out, you use the anger and resentment you have against your own life and choices and take it out on that guy who is doing the job he signed up for. Furthermore, since you cannot commit to “pulling the trigger” by signing the paperwork and keeping documentation near, you are giving your child the most difficult decision in the world when it is not up to her. Your daughter loves you, don’t make her decide your death when you have the time, mind, and opportunity to make your own decision for yourself. Hopefully, she took the necessary steps to avoid future issues, unneeded pressure on her daughter and clear orders to which medical personnel will adhere. The world over and throughout time, people will wish for death, even walk the thin line, yet cry few will actually commit. To exist is pain, but to live is to survive. No one is responsible for your life but yourself and in the terms of the end of your life in which you have a choice, it’s up to you to make that choice. Next time, sign your fucking name. Judgement for the defendant, your case is dismissed.

    Putting off DNR until the cardiac arrest happens and the fucking ambulance arrives with the papers by chance. Blaming the guy who resuscitated her as per the law and as is required of him in his job and then suing him. Why don't you sue your daughter as well for calling for the ambulance when you clearly didn't want to be resuscitated? I swear I hope one day the paramedics do a strike for a month. Either the morons who sue them for saving their lives or for their own negligence in health or legal paperwork all die out or someone will actually think "Hey, maybe we shouldn't allow this whole 'imma do a lawsuit cuz he saved my life' thing to happen?" and implement laws that protect the people CRUCIAL to the survival of a country from being punished for doing their goddamn jobs.

    Suing a paramedic for reviving you? That is one of the stupidest lawsuits I ever heard. You should be grateful that you survived. Besides, the Paramedic did what he was trained to do as a First Responder. You know that if he didn't give CPR and the patient dies, the Paramedic could have been charged with Criminal Negligence Causing Death or Manslaughter, and even possibility lose his job for Malpractice.

    DNR orders are only issued by a doctor. A personal directive is one that you can prepare with your lawyer. DNR forms don't exist exactly like the EMT is talking about here... They've cut out a number of steps. (A refusal of treatment form, signed by the patient, does exist as presented.) This lady MIGHT have been able to get a doctor to sign off on a DNR, but, it needs to be signed by the doctor to be valid and must be renewed regularly in order to avoid these types of court cases. Regardless, a DNR can be overridden in the event that it appears that there is any doubt that the patient might have changed their mind. Also, if the signed, original DNR cannot be produced at the time, the correct thing for the EMT and paramedics to do is to resuscitate. If an employee of a service follows all the proper protocols and procedures, the service will represent them in any court proceedings like this. He sounds like he did what his protocols say to do, so, somebody thought this would make good TV because, the outcome was a foregone conclusion.

If you do decide to pursue the DNR, many emergency medical services recommend that you keep a copy, (in this case it should be the ORIGINAL), in your fridge, along with a list of your medical history and medications. A service I used to work for called them the "capsule of life". I know it sounds odd, but, if your local service runs that program, or, one like it, they'll hand out what you need free of charge. Contact them, regardless, to discuss what your options are so your wishes can best be honored in future.

    statistics show that less than 18% of the elder people that receive CPR by EMT actually comeback to life, now I get the lady's wishes and I have no problem with that but for her to try to include the broken rip and talk bad to the hero that is the EMT is just sad, I really hope that the judge put a good word for the EMT at the end cause its just sad that he gets dragged to court after such a heroic work day

    I feel bad for the first plaintiff because I know what its like dealing with a life-long medical condition, but at the same time, the judge does have a point...if she was so adamant about not being resuscitated in the event of heart failure, she should have had that already prepared in writing BEFORE she had a heart attack....that way the medic could have seen that and not revived her. You can't say "Oh, I'm in so much pain....I just want to be let go" and then say "Well, in my condition, I just kept putting it off". The man was only doing his duty.

    Noooo, the video ended! I wanted to know what happened! If I had to guess I want to say the EMT won simply because the document was never properly signed and he had to do his job. Grrrrr I hate good stories with no ending! lol I work in the medical field and it's a "damned if you do and damned if you don't" type of thing and in order to protect ourselves, things have to be in writing and we have to follow what's in writing not a verbal agreement because people always tend to forget anything verbal. I hope the EMT won simply because he was right in this situation {in my opinion}.

    As one who has performed CPR 1 successful times out of three attempts, it's very common to break a rib, and health care MUST perform CPR unless it's a signed DNR.

    Both of my parents lived in Florida, the law Requires the people have to have a DNR at the house. This is her fault for not having the proper papers, and her daughters, not the paramedic.

    I sincerely hope he sided with the EMT. The DNR was not signed. Her negligence to have it done sooner is her fault. Her broken rib is a common occurrence because during CPR you are needed to put pressure on the chest and push at least 2 inches. Whether she said it or not it would fall on him that she died with no DNR.

    Diane Harman Why would you sue the EMT. His job was to save your life. You should of had a DNR on file at the hospital and in the safe at your house. In fact, you should of had the conversation with your daughter not to ever call 911 if your go into cardiac arrest. You totally blamed the wrong person. You are to blame....not your daughter (one of the most difficult position to be put in) or the paramedic. I hope you did not win this case.
