4 Real Signs of Retaliation at Work

The U.S. Equal Employment Opportunity Commission (EEOC) reports that in 2020 about 60 percent of all discrimination complaints related to retaliation. Luckily, this is why the EEOC exists, to protect employees from discrimination, harassment, and retaliation. There are many different signs that an employee may be facing retaliation after reporting misconduct at work. And just like discrimination and harassment in the workplace is illegal, so is retaliation.

Retaliation includes punishing employees for asserting their rights to be free from employment discrimination and harassment. Retaliation in the workplace is illegal and employees are protected by the federal government.
This protection also covers those that are not directly affected, but that report harassment they’ve seen.
Here are four signs of retaliation in the workplace.
Asking someone to accept a demotion from their current position, a suspension or a termination after they filed a harassment report are all forms of retaliation.
But while retaliatory termination is widely understood by most employers/employees to be illegal, demoting or assigning someone a less than ideal job duty can be more subtle.
Many employers hope that by doing this they can get an employee to leave or quit on their own.
Docking someone’s pay or the amount of hours they usually work is another common form of retaliation.
What could be the harm in changing the schedule of someone who hasn’t been showing up to work as often as they should, right? I mean, you want to schedule someone that is actually going to show up…
Believe it or not, this can leave a company wide open for a retaliation case.
For example, if someone is experiencing known medical issues that takes them temporarily out of work and an employer decides to cut their hours thereafter, this is illegal.
Imagine you’re up for a promotion. Before you accept the position officially, you notice there is an issue within the company that needs to be addressed. A new employee was subjected to harassment by someone in management, so you made sure to report it, as you should.
Well, the word got out to the rest of the company about the situation and management didn’t appreciate it. So to teach you a lesson, you didn’t get the promotion.
This is a perfect example of workplace retaliation.
Employers may think they’re beating the system because they aren’t outwardly firing someone. By not giving an employee a raise or a promotion after they make a report like in my example, they can still create an unfair work environment for the employee and punish them.
At the risk of sounding obvious, an employee who experiences physical/verbal abuse after making a report against their employer is likely experiencing a form of retaliation.
Many employees who report workplace retaliation say they experience verbal abuse by someone in management, but this can come from fellow coworkers, too.
If a threat of violence or a physical attack falls upon an employee at work, this is a criminal and unlawful act that needs to be addressed.
If you feel you’re experiencing acts of violence, you have the right to not only file a lawsuit but a police report as well.
There are many other different forms of retaliation that we weren’t able to cover today, but what we went over are going to be some of the more common ones. If you find after making a report of discrimination or harassment, your work environment becomes more hostile, consider these tips. Document the harassment and discrimination that led up to the initial report. Try to include dates, times, and who was a part of the incident. Make note of any acts of retaliation thereafter that you have seen. Include as much detail of the retaliation and harassment as you can such as emails, pictures, texts, paystubs, etc.

    I reported my boss to the state, but I got a funny feeling that the worker working on my case may have been paid off. My case seems to be in limbo.

    I’ve experienced almost all of this but somehow lawyers aren’t picking up the case. Maybe I’m not explaining myself correctly but I’m really trying not to lose hope right not

    No worker protection. Lawyers don’t want to take the case unless it has to do with some type of discrimination; religion, sexual orientation, ethnicity…. Etc. they want an easy win.

    Is it considered retaliation when HR asks anonymous feedback about your manager from all his subordinates and your manager somehow singles you on all negative feedback he may have received from HR right after, and starts singling you out. Btw you being in protected class over 40 years old and all others are much younger in this case, and he starts discriminates against you from then on?

    I believe that's true. I worked at a casino which they put to gether a setup which we would have to go on a computer to do it. Then afterwards I felt that's thing started changing

    What if you've had reported issues with a coworker and then their wife starts working with you as your boss but then waits for any opportunity to give you a write up about something that wasn't true even true and about something small? Feels like retaliation especially when they found out i never got a write up smh

    Hi! I love your informative videos. Thank you very much! I work in Information Technology. My salary hasn't decreased. I just received a 4% raise. Altogether, I feel very much mistreated and discriminated against at my job. Being with my company for 5 years, we switched our contract a year ago. The company seem to now hire mostly inexperienced males, paying them low wages or whatever they feel fit. Several of the new employees or good friends are related by blood to management. I'm near 50 years old and have worked extremely hard to move the company forward. I'm beyond numb because they just sent a mass email of the company's new transition. In the email, they announced all the newly hired employees, promotions, and department changes. In the email, I noticed they mentioned my name in a sentence congratulating a new employee/my new teammate. The department and title they mentioned her in with my name included is waaay beneath my job title. I came in as a software developer, and they put me under the title of client support. I was in shock and very much hurt. I immediately went to my supervisor's office in a professional manner to get answers, and he turned me away by stating, "it's just a title." I emailed the project manager and director, and they both totally ignored my emails. I also called HR. HR explained my job title coming in and still listed as 'software developer'. All the new employees are addressing me by the new title of customer support, as being labeled in the email. Every day, I walk in that place humiliated. Most of the employees there know I work extremely hard... It's very embarrassing and humiliating. Now, I'm noticing my supervisor is quietly moving my duties around. I'm pretty sure they are trying to save money, but I can't believe they would go this far to achieve whatever they are trying to achieve. They are totally ignoring me. I feel they are trying to make me resign or demote me...If so, I I feel they are going about it the wrong way. I'm job searching now because I feel like I've been used, lowballed, disrespected and mistreated. Do you have any constructive advice for me. I'm totally losing sleep over this.

    Get you a lawyer and pay what ever it takes for that one hour consultation. It's definitely worth the money and time. Keep up all documents and talk to knowbody about the hightled. Good day

    I feel your pain, humiliation and stress/frustration. I’m currently trying to sue a giant insurance company that made me work for nothing, they never paid me my commissions! Then they wouldn’t release my licenses and held me captive for 3 more months until I did it all myself. I found an atty but he just wants to settle and take his 3rd….so disappointing! I could settle for nothing on my own, I don’t need to pay him to end up with 30k. I’m also feeling so down and hopeless, I’m with you, owe bills and I wish us both luck!! Good luck to you, I hope in a few months we’ll both be happy with our settlements. I do know that no employer wants bad press, court or any employee telling the world or a jury how criminal, nasty and rotten they are treating employees illegally! God bless🙏

    Personally, I wouldn't see anything wrong with getting my hours cut after getting back from being sick for quite awhile. It's healthy for someone with depression, and I probably don't need the money I wouldn't get anyhow. After all, what is more important than a person's health?

    they ended up firing me lol but it was a good thing tho that job was terrible. I got a way better job after that happened.
