The ones who don't get caught are state aided hackers. Most freelance hackers will eventually get caught. The same is said for any criminal, if you stay in the game long enough you will eventually get caught.

Yes it is, to hack into anything you need permission to do so. Even if you break into whatever your doing and do nothing, you are still gaining unauthorized access.
