In this Google Hangout, Phoenix personal injury lawyer John Kelly provides some tips on how you can potentially double your personal injury settlement, with our without using an attorney.

The first one is that you want to try to establish liability. What that means is that the insurance companies are going to wonder who caused the accident. And you want to get that taken care of as soon as possible. So, you got to keep your evidence of photographs at the scene, talk to witnesses. If you're able to, get the police report.
The second tip. Do not give statements to any insurance companies. What this means is that you'll have both insurance companies, your own and the others. The one's who hit you. There'll be calling you and requesting a statement from you. I would advise you to hold off on giving any statements of not only your accident, how it happened, but also your injuries.
The third tip. Get diagnosed for any injuries that you have. So what this means is that if you have an injury, just don't sit on it and assume that the insurance companies going to give you credit for that injury based on what you tell them. You need to have a professional doctor diagnose that. So you might have to make an appointment with your primary care doctor. If you've already been to the hospital have referrals that you need to follow up with and get those scheduled. That's very important.
The fourth tip. Follow your doctor's orders for your treatment. So this seems like this would be self-explanatory but it becomes difficult with people that are in injuries and car accidents. That's because they have a lot going on. What you want to do is make sure you follow up with all of your doctor's orders. You do the treatment that they've recommended.
The fifth piece of advice. Get all your full bills and records. Now remember, most of these first ones that I'm going over, you don't need an attorney for these. There are cases where you may need an attorney to get involved. But these initial steps are all steps you could do to help you make sure that you're on the right track, right off the bat. So, the fifth step. Get full bills and records. So after you're done treatment or after you get out of the hospital.
The sixth point is to hire an expert to follow up with any deficiencies and outstanding issues in your case. If there's a problem with liability you may need to get someone to review your police reports, go to the scene, do an accident reconstruction. If there's issues that you've had, or preexisting injuries or preexisting conditions that the insurance company is telling you.
The seventh tip that I have. Once you have all this together, you make a demand on the insurance company. And typically you would just want to request a policy limits or an inflated amount that you believe covers all your medical records, pain and suffering and a few future costs that you have. It's sometimes easier to just ask for the full policy limits.
The eighth tip. You want to follow that up with some kind of threat of lawsuit. Understand that these insurance companies, if they see that you're representing yourself they think that you may not have the bite that comes along with them denying you your claims. So, you want threaten a law suit, and if you want to you can get an attorney involved at that point to write a letter for you to have that backing.
The ninth tip. Consult with an attorney regarding any timelines that you have. This may need to happen a little bit earlier because you want to know your statute of limitations. Every state is different. Some statute of limitations run after one year.
And the tenth tip to potentially doubling your claim is to work on your liens and your policy information with the insurance companies. There may be multiple policies, insurance policies that you can pursue. Or the individual individually. And you also have to worry about how the liens from the health care providers that you have. That's something that usually if you have a lot of those, you wanna consult with a a lawyer at least. Because those can add up and you can save up a lot of money to get reductions in your bills from the liens. A lot of the medical care providers will come back and say because you got a injury settlement where we want to be reimbursed.

    Hi, I found your video very informative and you seem to genuinly care. I was in a car accident while 7 months prgnant wit my son. The Attorney that I had for 3 yrs didnt help told me to seek other counsel knowing my statue was coming up. My question is Do i have right to file a complaint against him to stop the lein? I have injuries of neck..pinched nerve n minor buldge disc issue. Also has greatly increased my Anxiety too since the accident. There has been an offer for 20K. how do i know what my medical bills are? Once the adjuster makes an offer can he decrease it? The issue is my staute is coming up.The accident happened Nov 2014.     It looks like you may have a case against your lawyer for failing to file a lawsuit before the statute of limitations runs. You may want to call the State Bar in the state that you live in and ask them for a reference to a good malpractice lawyer.

I tried to file three different times a complaint To the state bar on my lawyer for malpractice.fist time they said it was incomplete.so the second time i doubled checked for the package to be good (statebar)they said the package couldnt be found. So the third time i turned in the application package and asked for a recipe for proof that i turnd it in .the answer i got was there was no sufficient evidence on me filing the claim on my lawyer. I really feel hes done malpractice. Can the malpractice my lawyer has done fall in the white collar section? My lawsuit has been going on for a while.. Got hurt Since 1995 Thank you in advance

    YOU should have made sure that your attorney filed a case LONG before the statute ran out. If it expires, all you can do is make a malpractice complaint with the State bar and sue your attorney for damages .

    People need to understand this. When you get hurt the first person you call is a attorney. he will direct you where to go after a fender bender. Hospitals do not write reports in your favor...

    Tip #11 If you have an attorney, ask them to reduce their bills. The standard attorney fee of 33.3% is usually the biggest bill! The attorneys love to discount your health provider bill, but usually don't like to reduce their own bill. If the attorney is getting more than you from your settlement, you've picked the wrong firm. Before you hire an attorney, ask them what their written policies are on reducing their bill.

    Good afternoon, i have a few questions to ask, 4 days ago my wife and kids were involved in an accident were the person who cause everything got a really bad insurance apperantly they dont have bodily injure coverage and all we can do out of this is have my insurance pay off the car and our insurance will claim a lawsuit against the other persons insurance at the moment my wife was pretty injured and she was taking to anhospital because the air bags exploded and hit her face to the point that hit her noise and she was bleeding a lot her neck and her yaw was hurting and her whole body is full of bruises our lawyers have been saying that theres nothing i can do and theres no sue case in this scenario but the person that cause the accident could have kill my kids and this was an action of irresponsibility!

    Also I don't get no work comp/ I apply for short-term disability but I was thinking to just go back to work because I honestly can't sit out another 60 days and I feel like I can get back to work and made more money than disability provides My car just got repoed, maybe I'm panickg idk.

    I’m genuinely curious, if an apple charger randomly started to burn up and began causing a small fire can I at all press charges, I got a very slight third degree burn but it’s small, just curious as it had the potential to cause a real fire had I not woken up to the burnt smelt, sorry if this is a dumb question

    From my experience it's best to file your own claim get claim, policy number. Thus way if the attorney bails on you, you're know who the insurer is. Yes get your own medical bills, records and redact or eliminate medical history unrelated to claim. Don't give your social security number.

    Im 8months out from injury date & just found out I need surgery by orthopedic surgeon. I was told I need screws in my foot & toe needs repaired due to deformity. I go for another mri then ill get date for surgery. Then be off that much longer to recover. Im already so depressed bc Im cooped in my house with a messed up foot & bc Im broke bc I get paid less than $300/wk Im behind on every bill I have. I have to beg or get extention on everything every month just to keep them on. I have a 13yr daughter to support & provide for along with everything else thsts needed. My anxiety is so bad that im to the point i know i need medication but i dont hv ins so I sit & suffer. I stay so stressed I can not enjoy myself or life anymore. & now being told 8 months from injury i need surgery has me so overwhelmed that Im ready to give up. I cant do this & struggle & stress like this. Help

    Mr Kelly, I had 2 spine surgeries in 2019, 1 neck fusion and L2 fusion, Aug 5 was my neck surgery and January was my L2, well Nov 17, 2019, someone slammed into me cutting me off the road and totaling my car, we waited for the police for about 1 hr, we exchanged information and she agreed it was her fault and my friend came to the scene and took me to the hospital, because my neck and arms were hurting and later my low back was hurting me too at L4, they did a m.r.i on my neck and found spinal stenosis at 2 levels, which wasn't there months ago, I had the m.r.i at the same place, the surgery's I had are fine and my low back hurts like hell, I need morphine, before the accident I was fine, plus my pain management Dr was to put in a fentanyl pump, plus my surgeon wants to check L4 and refuse it and my neck, I see him friday about that, but the back surgery is set for july 22, then 6 weeks later the pain pump, I also was back to work for 3 months, but the pain was so bad I had to sell everything at a loss, it was a company car with 1 million binder, plus auto insurance, should I try to settle this my self, because my medical Bill's will be around 300k plus business loss and income, I feel we are at a million, plus management of the pain pump is $5000 to 7000 a yr and they need to put a new one every 6 to 8yrs, thats$ 30k, I'm in FL we have 4yrs to file a lawsuit.

    You can always see what kind of offer you will get from the adjuster. However, insurance companies are very savvy with unrepresented individuals. You will have some complexities with medical bills, liens, wage loss, and others that I believe would necessitate a local attorney at least reviewing your case with you. I wouldn't suggest representing yourself with such serious injuries.

    There is a huge variety of outcomes with a concussion. Sometimes, the symptoms of concussions last only a few days, other times the symptoms remain for years. It is very difficult to say what the average amount is when it depends on a lot of other factors. If you miss a day or two of therapy, it shouldn't be an issue. You may want to make sure you have a reason you missed in writing to the adjuster or your attorney.

    I have a question, my friend told me that she hasnt recieved any $$ for the damages of her vehicle, nor have recieved a rental car. But iv been driving her around to her appointments, does the insurance that was at fault has to cover for the mileage i use for those trips?     Hi Lisa, in my experience obtaining incidental costs for a friend is not something insurance companies have been paying. Technically, you would need to make a separate claim under your own name. You may want to speak with an attorney in your city to see if it would be an option.

    I have a few questions please sir , I hired a attorney to handle my case after a wreck this past August after signing a contract in the next few days I was told u would have to handle the property part of my claim leaving me to fight on my behalf for a rental car which I did not get until six weeks later an only got for one week then anb had to fight an argue with the adjuster for three of those days, and I still got left having to pay for the insurance on it bc I had let my insurance lapse bc my car was totaled an I had no need or means of paying any thing bc I was severely injured I had to bum and beg a ride to Dr appointments in another country which I had to eventually quit going bc I had no way I barely got enough to pay lien holder not leaving me with enough to replace my car. Plus causing me to have a balance with rental car place. And then after having to handle that I had to call around and get info for my medical and then it was time to send demand letter I had to call the Dr that my attorney referred me to add had me sign a pretreatment lien to be able to get a brace for my wrist is all I needed and the Dr I had to sign a blank piece of paper for charged excessive fees for seeing me I was informed of this not none was I told he will charge me$3467 for 4 in house office visits he never touched me performed no kind of procedure except two x-rays also he would only see me for one injury per visit he was only taking my money not doing any kind of medical treatment writing any kind prescriptions he did write a release for me to go back to work after I asked him to I was not healed but I was going under financially and not to mention I seen he was only after my settlement money did not care about my injuries if he did I wouldn't of had to made a appointment per injury bc they would've needed care then not when the next appointment was available . My lawyer did not try and protect my settlement at all except when I asked for presettlement loan I was told no that they charged to much interest but it was ok for there referral to charge excessive against my funds. I was denied a personal meeting with my attorney I was told he would see me when there insurance made a offer which was a lie bc he accepted the first offer an had the paralegal call me and tell me that and prior to that the paralegal told me when I asked if my demand letter had been sent that she said was still waiting on the Dr that I signed the lien for the bill bc the lady that does the billing was out for two weeks and we would not be able to send it until she returned so as soon as I read that email I called the Dr office and the lady that was supposedly out for two weeks answered the phone I told her that someone was suppose to b out and she said that is me that she had just spoke with his office and my Case was not mentioned but she would get in it and send it over to them that day. So I was lied to by him through her and by her, get being the paralegal I hired the attorney not a paralegal and if I had known I was going to have to do most of the work I wouldn't of hired them I feel like I've been treated disrespectful and disregarded my needs an wants the medical was not questioned by then I was not asked to check bills to make sure no errors anb the doctor charged$600 more just for speaking with me and x-rays and a brace than the Dr that operated on my arm saw me and released me from hospital prescribed medication provided after care with my stitches etc. He charged 2800 for services and when I called to speak with them about my bill bc my attorney asked for 90-95% reduction for all my medical which was 136000 except for the Dr they referred I was told I could not dispute or reduce that bill so I feel like I was set up from the get go I only got 25000 thanks to my lawyer and he was going to try and satisfy the providers regardless if I had anything left to get back up on my feet I fired him and asked him to have my file and funds ready I could not trust him to act on my behalf and he will not give me my file or funds and I have no way of going no money and I'm at my wit's end stressed out is not even close to what I am he is getting 33-40 and I have no idea how much more bc I can't get copies of anything from them I never had one person to person call text or meeting with my lawyer I feel like I've been screwed over bad and I do not know what to do I've called the state bar and I received a form to fill out can I seek further damages from the attorney and Dr bc the no surprise act was passed 1-1-21 will that help me in any way plz I need to know I'm left no better off and really and truly worse off than before I hired him he protected everyone's rights but mine I did not hire him to protect my providers I hired him to protect mine and it ended up I delt with paralegal an done most of work except for demand letter help me plz

    You can create a statement of the events and provide it to the insurance company. Understand, that any statements you provide can later be used against you later down the line of litigation. There are circumstances where it is helpful to provide your side of the story. Particularly when there are no other witnesses or evidence that would be able to prove what happened. As always, I'll advise you to consult with an attorney about the statement before sending it.

    At fault driver only has 30K policy which is the minimum state requirements in this state. My medical bills amount to over her policy limits. Her company Allstate only wanted to settle for 19K. Attorney filed suite on them. I had coverage for underinsured and uninsured coverage on my vehicle that was totaled plus higher than state minimums than at fault driver. Am I able to file a claim against my own insurance policy? Still waiting on my trial date which has been pushed back. We are going on two years after the accident and still getting treatment for medical problems caused from the accident. Allstate from what I am hearing does not play fair.

    Generally, you would need to wait under these circumstances, but there are always exceptions that could give you the ability to make an underinsured claim now. I would need to review the policy and your state's laws to give a definitive answer to this question. Have you asked your lawyer to do this?

    There are several circumstances where you do not have a report after an accident. Often, the police will not come to the scene if you are on private property. Or, there are times where you are in a dangerous situation and need to exchange information with the other party and get out of dangers way. In these circumstances it is a good idea to document the accident as best as you can. Take several photos and possibly go back to the scene. Get witnesses statements and take notes. Every case is different so I'd advise to reach out to a lawyer in your area.

    I don't work in North Carolina, I can say that it may be a bad idea to ask for policy limits in certain circumstances. Especially if your injuries do not justify a settlement for the policy limits. I'd sit down with your lawyer and have them explain why they believe a policy limits demand is not appropriate.

    If you get your vehicle repaired, the insurance company owes you the diminished value of the vehicle, or depreciation caused by the accident. You can ask your body shop to give you a diminished value report, or call around to see if you can find a repair shop to give you a report. This will provide you with evidence to then request the diminished value.

    Hell yes! It’s called diminished value. Don’t let them screw you around hire an expert appraiser who deals with this an have him figure what your car was worth before the accident and how much the value has dropped after repairs. We had a Mercedes with $ $9,000 damage. We got it fixed and then went after the insurance company for the reduced value. Especially with high dollar cars. Buyers who want to buy a car like yours in the future usually won’t touch it if it has any kind of body work.

    If Medicare has paid the bills already, the Dr's. Request more money because Medicare doesn't pay them as much as they would want to charge. I.e. more than Medicare is contracted to pay of what they billed.

    This is a good question. I often represent people who have preexisting conditions such as back pain that are injured in an accident and have their symptoms become worst. The idea is to get the doctor that had seen you in the past to provide a new evaluation to see how far back you have gone. A good doctor can do this and provide us with the notes needed to show where you are in comparison to where you were before the accident.

    My son was offered $1250.00 for multiple contusions. Left rib, left hip, neck, arm and leg. Do you think this is a fair offer? Took him 3 weeks before he could really lift much of anything.

    As long as the insurance company has accepted liability, there is no reason you shouldn't be able to get your car repaired within the first week of the accident. There are things that can delay the process and every case is different, but I often resolve the property damage very soon after the accident. Please contact a lawyer in your state with details on this.

    @@johnkelly8670 lol currently my car is in the shop with the other persons insurance being responsible of the damages, 2 weeks later after my car being the shop, their adjuster says my rebuilt title car is deemed total loss because the repairs are more expensive than the car,but the prices looked exaggerated to me,how would that be my fault if my car was roadworthy before their insured driver rear ended me.I currently have an attorney for injury claim because of the injuries I got from that accident.Can you please help and let me know what I can do to get my property damage fixed or do I give them car for their price estimate.

    Long story short a drunk driver hit my wife ,son and i. I got a attorney every thing has been looking good. But since it was 3 of us involved. The law firm is charging us 40% each . instead of charging us 40% for a case . im in California someone please help...

    CA Law, It should only be 1/3 for each adult and max 25% for a minor, unless negotiated.

    Not from the state Or even the country So your answer would not apply to me Or be admissable However in a case where there is a injury And you heard the statement from the person injured Its pretty much a fair case against someone with a profession duty of care that they did not do And his/her insurance is the defendant Later but before the statement of claim the "professional" has made a breach (peaceful enjoyment ) And "hearsay" thereafter of words But proof of the breach .....In Phoenix, in courts Is that a added on part of the case ? Or does that go into another case?..........Alot of people have accidents The have injuries But when you get into Anxiety and depression And added on issues I understand the next step to inform the lawyer But is there a time limit on adding on issues ontop of a case? Do you have any examples of cases that would be on google?

    From my experience, Yes you can "counter offer" their low ball offer. Find strengths of your case and argue it to demand more money. I was told to never except the 1st offer, it's their bottom line pay off.
